JEROME, A.C.J.:

     By letter addressed to the Court on April 27, 1997, the appellant indicates that among other reasons for delay which may have been entirely valid, he failed to receive the notice, a fact which appears to be confirmed by information under Federal Court memo dated April 9, 1997.

     Accordingly, subject always to the discretion of the presiding Judge, this appeal will be allowed to proceed.
