1 The motion before me seeks an extension of time within which to file the applicant's record. To show the existence of an arguable case, the applicant's lawyer refers me to the applicant's record which should not be before the Court as the motion is to seek leave to file that record. As I have stated in other cases, I believe it improper for that record to be tendered in evidence. In most cases I would order the applicant's record returned. However in this case, counsel for the Minister upon whom the record has been served has indicated that the Minister does not oppose this motion on the merits. In my view, the delay has been excused and there would appear to be some evidence of an arguable case for leave. The motion will therefore succeed.
ORDER
2 The time for filing the applicant's record is extended to the 30th day of June, 1998. Serving of a copy on counsel for the Minister is validated and the time for filing the respondent's submissions and supporting materials is extended to the 30th day of July, 1998.
