     ORDER AND REASONS FOR ORDER

RICHARD J.:

[1]      This is a motion by the plaintiff dated October 20, 1997 to renew the order for an interim injunction issued by Noël J. ex parte on October 20, 1997 for a period terminating October 27, 1997, as amended by the order of Tremblay-Lamer J. dated October 21, 1997. My decision is limited to the instant motion. The plaintiff relies on the evidence in her affidavit of October 15, 1997, and more specifically to that relating to irreparable harm in paragraphs 14, 15, 16, 27 and 28.

[2]      The motion is dismissed. Although the plaintiff has proven that there is a serious question to be tried, she has not satisfied me, based on the evidence in the record at this time, that she will suffer irreparable harm should she be denied relief. Proof of irreparable harm must be clear and must not be based on conjecture. Furthermore, the defendants Les Productions Folle Avoine Inc. and Les Productions Photogéniques Inc. undertook as of October 27, 1997 to keep separate and detailed books of all sales and receipts relating to the by-products shown in illustrations R-1 to R-9 and to report those sales and receipts to the plaintiff during any examination for discovery or hearing on the merits of the instant case. These two defendants are Canadian companies and are the distributors of the products the plaintiff alleges to be in infringement of her copyright.
