Docket: IMM-6073-00

BETWEEN:

     JANUSZ PRZYWALA

     Applicant

     - and -

THE MINISTER OF CITIZENSHIP AND IMMIGRATION

     Respondent

     REASONS FOR ORDER AND ORDER

BLAIS J.

[1]      This is an application for a motion for a stay of the removal order of the applicant from Canada.

[2]      The applicant is to be removed on November 29, 2000.

[3]      The applicant failed to substantiate his allegation that it is not reasonably practicable to execute the removal order made against him.

[4]      In my view, the applicant failed to convince the Court that there is a serious issue to be tried.

[5]      Pursuant to the allegation by the applicant's brother that the applicant needs some type of medical specialist attention, again, these allegations are not supported by any medical evidence.

[6]      The applicant failed to provide any evidence that he could suffer irreparable harm if removed from Canada.

[7]      Considering the statutory duty for the Minister to execute removal orders, in my view, the balance of convenience favours the respondent.

[8]      For those reasons, this application for a stay is denied.
