MONTRÉAL, QUEBEC, THE 6TH DAY OF JANUARY, 2000

PRESENT:      THE HONOURABLE MR. JUSTICE LEMIEUX

BETWEEN:

RUVI ESPERANZA DUQUE DONIS

Applicant

AND

THE MINISTER OF CITIZENSHIP

AND IMMIGRATION

Respondent

Judicial review of the decision of the Immigration and Refugee Board rendered on February 4, 1999 by members Richard Quirion and Jean Prévost in docket M98-03805.

[Section 82.1 of the Immigration Act]

ORDER AND REASONS FOR ORDER

[1]      This application for judicial review was heard after I had allowed the motion to cease representing by the applicant"s solicitor.

[2]      After reviewing the evidence, reading the decision of February 4, 1999 of the Refugee Division (the panel), which ruled that the applicant is not a Convention refugee, I am persuaded that the panel"s findings concerning the applicant"s lack of credibility are based on the evidence and that the contradictions it identified are significant and not unreasonable.

[3]      In the circumstances, the panel could find that the evidence submitted by the applicant did not establish a reasonable possibility of persecution should she return to Guatemala.

[4]      For these reasons, the application for judicial review is dismissed.
