     REASONS FOR ORDER

PINARD, J. :

[1]      This is an appeal pursuant to subsection 14(5) of the Citizenship Act, R.S.C. 1985, c. C-29 (the Act) of the decision of Arthur Miki, Citizenship judge, rendered and communicated to the appellant by way of a letter dated November 17, 1998. The Citizenship judge held that the appellant had failed to accumulate the number of days for residency required by paragraph 5(1)(c) of the Act.

[2]      In light of the unusual allegations contained in the appellant's affidavit filed in support of this application, the parties have agreed that the appeal be allowed and that the matter be remitted for reconsideration by another Citizenship judge.

[3]      The within appeal is therefore allowed and the matter remitted for reconsideration by another Citizenship judge.
