Docket: T-2878-96

BETWEEN:

IN THE MATTER OF THE CITIZENSHIP ACT,

             R.S.C., 1985, c. C-29

AND IN THE MATTER OF an appeal from the

             decision of a Citizenship Judge

             AND IN THE MATTER OF

             SAU KING TSE,

     Appellant.

     REASONS FOR JUDGMENT

[1]      The appellant appeals from the decision of the Citizenship Judge dated December 18, 1996, denying the appellant's application for a grant of citizenship on the ground that she did not meet the residence requirement of paragraph 5(1)(c) of the Citizenship Act.

[2]      This appeal was heard together with the appeal by her husband in File No. T-2877-96. The appellant landed in Canada with her husband and absented herself from Canada for the same number of days as her husband. She accompanied her husband on his absences from Canada to assist him on his business trips and to assist him with his hearing disability. She adopted the evidence given by her husband.

[3]      I find that she has also met the residence requirement in paragraph 5(1)(c) of the Act.

[4]      Accordingly, her appeal is also allowed.
