[1]      The assessment of the respondent"s bill of costs was held on December 21, 1999. The bill of costs was filed pursuant to the judgment rendered on January 19, 1999 dismissing the appeal by the applicant Max Berdugo and to the order of March 12, 1999 ordering that the costs of this proceeding be awarded against this applicant-respondent.

[2]      At the hearing, Ms. Valerie Tardif, the defendant"s counsel, stated that the parties had a verbal agreement as to the amount to be assessed. A letter from the applicant"s counsel was received the following day confirming the amount of the agreement.

[3]      Pursuant to the agreement, the fees provided for in item 2 are reduced to 4 units, in item 6 to 1 unit and in item 14 to 2 units X 5 hours. The fees provided for in items 7, 13, 25 and 26 and the costs are allowed as requested in the bill of costs.

[4]      Consequently, the costs of the defendant in this matter are fixed at $2,540.46. A certificate shall issue in this amount.
