     REASONS FOR ORDER AND ORDER

RICHARD MORNEAU, ESQ., PROTHONOTARY:

[1]      This is a motion in writing by the Respondent for an order quashing the Applicants" Application for leave and for judicial review (the Application) on the grounds that the Application was prepared, written and signed by an individual who, at all relevant times, could not validly act in proceedings before this Court.

[2]      In support of the motion at bar, the Respondent submitted an affidavit which discloses further the grounds in support of the motion. It reads in part as follows:

2.      Le 14 mars 2000, le demandeur a déposé une demande d'autorisation et demande de contrôle judiciaire portant le numéro IMM-1303-00.
3.      Cette demande d'autorisation est signée Gordon J. Prieur, Attorney.
4.      J'ai vérifié dans le Journal du Barreau daté du 1er décembre 1999 et j'ai constaté que monsieur Gordon J. Prieur n'était plus inscrit au Tableau de l'Ordre du Barreau du Québec, celui-ci n'ayant pas payé ses cotisations, le tout tel qu'il appert de la pièce "A" de mon affidavit.
5.      Après avoir reçu la demande d'autorisation dans le présent dossier, j'ai également vérifié au Barreau du Québec le ou vers le 17 mars 2000 et monsieur Gordon J. Prieur n'avait pas régularisé sa situation.
6.      Tous les faits mentionnés dans le présent affidavit sont vrais.

[3]      I am satisfied with the grounds raised by the Respondent. However, I am not convinced that the remedy to be granted by this Court should be to strike out the Application. This remedy would appear to the applicants to be too harsh to resolve a situation which is most likely unkown to them.

[4]      Consequently, this motion is denied with leave to the Respondent to apply for a remedy which better fits the situation at hand.

[5]      These reasons for order and order are applicable as well to file IMM-1304-00 and a copy of same shall be filed therein.
