Direction to Counsel (from Justice Little, Chairperson)

 

Re: Release of Confidential Level A Reasons for Order and Order (“Confidential Reasons”)

 

The Tribunal directs the parties and counsel not to share the Confidential Reasons, or its contents, with anyone involved in the ongoing proceedings in Commissioner of Competition v Rogers Communications Inc. and Shaw Communications Inc. (“Rogers-Shaw”), until a non-confidential version is released to the public (the preparation of which is directed in paragraph 801 of the Confidential Reasons).

 

The Commissioner may seek further direction from the Tribunal, if necessary, to disclose the Confidential Reasons to a limited number of person(s) in the Competition Bureau’s senior management who are also involved in the Rogers-Shaw matter.

 

The Tribunal will release a public Information Statement that provides a technical summary of its decision in this matter. A copy is attached to this Direction.
