CERTIFICATION ORDER

WHEREAS the Associated Designers of Canada was first certified on January 4, 2002, to represent a sector composed of all set, costume, lighting and sound designers throughout Canada, who are independent contractors engaged by a producer subject to the Status of the Artist Act, within the live performing arts industry, excluding:

a. set, costume, lighting and sound designers engaged by a producer subject to the Status of the Artist Act in a production presented in the province of Quebec;

b. set, costume, lighting and sound designers engaged by the French language theatre department of the National Arts Centre.

AND WHEREAS the certification order has been continuously renewed in accordance with section 28 of the Status of the Artist Act, including most recently by the Canada Industrial Relations Board (the Board) on January 4, 2023 (Board order no. 10405-U);

AND WHEREAS the Board has received an application from the Associated Designers of Canada, Local ADC 659, International Alliance of Theatrical Stage Employees, Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada (the applicant), pursuant to section 30 of the Status of the Artist Act, seeking to amend the certification order to reflect the name change of the Associated Designers of Canada to the Associated Designers of Canada, Local ADC 659, International Alliance of Theatrical Stage Employees, Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada, as a result of a formal affiliation and merger of artists’ associations;

AND WHEREAS, following investigation of the application and consideration of the submissions of the applicant, the Board has determined that a merger of artists’ associations has occurred.

NOW, THEREFORE, it is hereby declared by the Canada Industrial Relations Board that the

Associated Designers of Canada, Local ADC 659, International Alliance of Theatrical Stage Employees, Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada

is certified to represent a sector composed of all set, costume, lighting and sound designers throughout Canada, who are independent contractors engaged by a producer subject to the Status of the Artist Act, within the live performing arts industry, excluding:

a. set, costume, lighting and sound designers engaged by a producer subject to the Status of the Artist Act in a production presented in the province of Quebec;

b. set, costume, lighting and sound designers engaged by the French language theatre department of the National Arts Centre.

AND THAT, pursuant to section 30(1) of the Status of the Artist Act, the Associated Designers of Canada, Local ADC 659, International Alliance of Theatrical Stage Employees, Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada is now the successor association and, as such, has acquired all the rights, privileges and duties of the Associated Designers of Canada with respect to the aforementioned sector.
