IN THE MATTER OF THE

WHEREAS the Canada Industrial Relations Board (the Board), by order no. 10496‑U dated November 15, 2013, certified the International Association of Machinists and Aerospace Workers as the bargaining agent for a unit of employees of L-3 Communications MAS (Canada) Inc.;

AND WHEREAS the Board has received an application for certification pursuant to section 24(1) of the Canada Labour Code (the Code) from the applicant seeking certification as bargaining agent for a unit of employees of L-3 Communications MAS (Canada) Inc.;

AND WHEREAS the employer advised the Board that on October 14, 2017, L‑3 Communications MAS (Canada) Inc. and 7553749 Canada Inc. amalgamated as one company, with the resulting entity being L3 Technologies MAS Inc.;

AND WHEREAS the applicant and the certified bargaining agent confirmed that the name of the employer is L3 Technologies MAS Inc.;

AND WHEREAS, for the reasons set out in L3 Technologies MAS Inc., 2022 CIRB 1042, the Board has found the applicant to be a trade union within the meaning of the Code;

AND WHEREAS, by order no. 1366-NB, the Board ordered that a representation vote be conducted among the employees in the proposed bargaining unit in order to ascertain whether a majority of the employees in the bargaining unit wished to be represented by the International Association of Machinists and Aerospace Workers or the Aircraft Mechanics Fraternal Association;

AND WHEREAS, following investigation of the application, consideration of the submissions of the parties concerned and the taking of a representation vote, the Board has determined the unit described hereunder to be appropriate for collective bargaining and is satisfied that a majority of the employees of the employer in the unit wish to have the applicant trade union represent them as their bargaining agent.

NOW, THEREFORE, it is ordered by the Canada Industrial Relations Board that the Aircraft Mechanics Fraternal Association be, and it is hereby certified to be, the bargaining agent for a unit comprising:

all employees of L3 Technologies MAS Inc. at Trenton Airforce Base performing aircraft maintenance and related service functions, excluding office and clerical employees, Senior Technicians (DND Tutor), supervisors and those above the rank of supervisor.
