IN THE MATTER OF THE

WHEREAS the Canada Industrial Relations Board (the Board), by order no. 10217‑U dated February 13, 2012, certified the International Association of Machinists and Aerospace Workers, Transportation District 140, Local Lodge 16, as the bargaining agent for a unit of employees comprising:

all employees of G4S Secure Solutions (Canada) Ltd. engaged in security screening, including the screening of passengers, baggage, airport employees, non-passengers, vehicles and cargo at the Campbell River Airport, Campbell River, British Columbia, excluding service delivery managers and those above the rank of service delivery manager.

AND WHEREAS, on or about April 5, 2021, G4S Secure Solutions (Canada) Ltd. was acquired by Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services;

AND WHEREAS, on or about November 7, 2021, G4S Secure Solutions (Canada) Ltd. and Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services amalgamated as one company;

AND WHEREAS a collective agreement between the International Association of Machinists and Aerospace Workers, Transportation District 140, Local Lodge 16 and G4S Secure Solutions (Canada) Ltd. was in effect until March 31, 2021;

AND WHEREAS the Board has received an application, pursuant to sections 18 and 44 of the Canada Labour Code (the Code), seeking a declaration that the sale of G4S Secure Solutions (Canada) Ltd. to Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services, constitutes a sale of business within the meaning of the Code;

AND WHEREAS the employer does not oppose this request;

AND WHEREAS, after investigation of the application and consideration of the submissions of the parties concerned, the Board has determined that a sale of business has occurred within the meaning of section 44 of the Code and that Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services, is the successor employer.

NOW, THEREFORE, the Canada Industrial Relations Board declares that a sale of business has occurred within the meaning of the Code, that Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services is the successor employer, and that the International Association of Machinists and Aerospace Workers, Transportation District 140, Local Lodge 16 continues to be the certified bargaining agent for a bargaining unit comprising:

all employees of Universal Protection Service of Canada Corporation, doing business as Allied Universal Security Services engaged in security screening, including the screening of passengers, baggage, airport employees, non-passengers, vehicles and cargo at the Campbell River Airport, Campbell River, British Columbia, excluding service delivery managers and those above the rank of service delivery manager.

FURTHERMORE, the Board declares that, pursuant to section 44(2)(c) of the Code, the parties continue to be bound by the collective agreement applicable to the unit on the date of the sale of business.
