WHEREAS the Canada Industrial Relations Board (the Board) has received an application from the applicant, pursuant to section 38(1) of the Canada Labour Code (the Code), seeking revocation of the voluntary recognition agreement between the Canadian Marine Mates and Engineers Union and NACC Shipping Canada Limited for a unit of employees comprising the:

Navigation and Engineering Officers on the NACC Argonaut

AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, the Board determined that it would be appropriate to treat the application as having been filed pursuant to section 38(3) of the Code;

AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, the Board is satisfied that a majority of the employees in the bargaining unit no longer wish to be represented by the Canadian Marine Mates and Engineers Union;

AND WHEREAS the bargaining agent has not opposed this application.

NOW, THEREFORE, it is ordered by the Canada Industrial Relations Board that, pursuant to the provisions of section 39 of the Code, the Canadian Marine Mates and Engineers Union is no longer entitled to represent the above-described voluntarily recognized bargaining unit of employees of NACC Shipping Canada Limited.
