IN THE MATTER OF THE

Bradley Air Services Limited carrying on business as Canadian North,

Kanata, Ontario,

employer.

WHEREAS the Canada Industrial Relations Board (the Board), by order no. 11505‑U dated May 1, 2020, declared that a sale of business had occurred within the meaning of the Canada Labour Code (the Code), that Bradley Air Services Limited carrying on business as Canadian North was the successor employer and that Unifor continued to be the certified bargaining agent for a bargaining unit comprising:

all employees employed in the Commercial Operations (Airport and Cargo Operations) division and the customer contact centre of Bradley Air Services Limited carrying on business as Canadian North, excluding departmental administrative and support staff, instructors, supervisors and those above.

AND WHEREAS the Board has received an application from the applicant union, pursuant to section 18 of the Code, seeking to amend the said order by including crew schedulers employed in the operation control centre in the bargaining unit and by excluding duty managers from the bargaining unit;

AND WHEREAS the employer is not opposed to this application;

AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, including a review of the confidential membership evidence filed respecting the employees that the applicant seeks to add to the existing bargaining unit, the Board has determined that the applicant has demonstrated majority support within the group of employees that it seeks to add to the existing bargaining unit and that those employees wish to be represented by the applicant;

AND WHEREAS, the Board has determined that it is appropriate to grant the application.

NOW, THEREFORE, it is ordered by the Canada Industrial Relations Board that Unifor be, and it is hereby certified to be, the bargaining agent for a unit comprising:

all employees employed in the Commercial Operations (Airport and Cargo Operations) division and the customer contact centre and crew schedulers employed in the operation control centre of Bradley Air Services Limited carrying on business as Canadian North, excluding departmental administrative and support staff, instructors, duty managers, supervisors and those above.
