IN THE MATTER OF THE

WHEREAS the Canada Industrial Relations Board (the Board), by order no. 11366-U dated March 5, 2019, certified the Canadian Air Line Dispatchers Association as the bargaining agent for a unit of employees of WestJet Encore Ltd.;

AND WHEREAS the employer disputed the inclusion of the position of Technical Dispatcher in the bargaining unit;

AND WHEREAS, pursuant to its powers under section 20(1) of the Canada Labour Code (Part I–Industrial Relations), the Board reserved its jurisdiction with respect to the final description of the bargaining unit;

AND WHEREAS the parties were invited to file further submissions with respect to the disputed position;

AND WHEREAS, after review and consideration of the detailed materials on file, the Board is of the view that the position of Technical Dispatcher has comparable characteristics to the Chief Dispatcher – Training and Standards, performs duties in support of dispatchers’ work and shares a sufficient community of interest with members of the bargaining unit;

AND WHEREAS, the Board has determined that the position of Technical Dispatcher is to be included in the bargaining unit.

NOW, THEREFORE, the Canada Industrial Relations Board confirms that the Canadian Air Line Dispatchers Association is certified to be the bargaining agent for a unit comprising:

all dispatchers employed by WestJet Encore Ltd., excluding the Manager-Flight Dispatch, the Manager-Flight Technical & Ops and those above.
