IN THE MATTER OF THE

WHEREAS the Canada Labour Relations Board, by order no. 1355-U dated March 25, 1964, certified the International Association of Machinists as the bargaining agent for a unit of employees of Consolidated Aviation Fueling of Toronto Limited;

AND WHEREAS the Canada Industrial Relations Board (the Board) has received a joint application from the applicants, pursuant to section 18 of the Canada Labour Code (Part I–Industrial Relations) (the Code), seeking to amend the said order by updating the bargaining unit certificate to reflect the changes that have occurred since order no. 1355-U was issued;

AND WHEREAS, in September 1964, the certified bargaining agent changed its name to the International Association of Machinists and Aerospace Workers;

AND WHEREAS, on March 27, 2002, Consolidated Aviation Fueling of Toronto Limited changed its name to Consolidated Aviation Fueling of Toronto, ULC;

AND WHEREAS, on April 13, 2017, Consolidated Aviation Fueling of Toronto, ULC changed its name to Allied Aviation Fueling of Toronto, ULC;

AND WHEREAS the parties are bound by a collective agreement which expired on December 10, 2016 but which continues to apply pursuant to Article 23 of that Agreement;

AND WHEREAS, given the passage of time, the classifications referred to in Board order no. 1355-U, issued in 1964, have become obsolete;

AND WHEREAS, following investigation of the application and consideration of the submissions of the parties concerned, the Board has determined that it is appropriate to grant the application;

NOW, THEREFORE, the Board hereby declares that the International Association of Machinists and Aerospace Workers is the bargaining agent for a bargaining unit comprising:

all fueling and fueling maintenance personnel of Allied Aviation Fueling of Toronto, ULC working at the Lester B. Pearson International Airport in Mississauga, Ontario, excluding supervisors and those above the rank of supervisor.
