IN THE MATTER OF THE

WHEREAS the Canada Labour Relations Board, by order no. 7428-U dated July 31, 1998, certified the Ontario Regional Employee Association as the bargaining agent for a unit of employees of Air Georgian Limited comprising:

all employees of Air Georgian Limited at Pearson International Airport, excluding supervisors and those above, crew chief, chief pilot, maintenance director, operations director, flight operations manager, production manager, training manager, charter coordinator, contract liaison, lead hand, flight safety officer and controller;

AND WHEREAS the Canada Industrial Relations Board (the Board) has received an application pursuant to section 18 and 18.1 of the Canada Labour Code (Part I–Industrial Relations) (the Code) seeking a review of the bargaining unit structure at Air Georgian Limited and a determination that three distinct bargaining units are appropriate for collective bargaining;

AND WHEREAS, on January 26, 2017, the Board issued its decision in Air Georgian Limited, 2017 CIRB 847 in which it granted the application for review and determined that the bargaining unit structure would comprise three distinct bargaining units; 

AND WHEREAS the Board has received an application for certification pursuant to section 24 of the Code from the applicant seeking certification as bargaining agent for a unit of employees of Air Georgian Limited comprising:

all pilots employed by Air Georgian Limited, excluding supervisors, those above the rank of supervisor, crew chief, chief pilot, maintenance director, operations director, flight operations manager, production manager, training manager, charter coordinator, contract liaison, lead hand, flight safety officer and controller;

AND WHEREAS, following investigation of the application, consideration of the submissions of the parties concerned and the taking of a representation vote, the Board has found the applicant to be a trade union within the meaning of the Code, has determined the unit described hereunder to be appropriate for collective bargaining and is satisfied that a majority of the employees of the employer in the unit wish to have the applicant trade union represent them as their bargaining agent;

NOW, THEREFORE, it is ordered by the Canada Industrial Relations Board that the Air Line Pilots Association, International be, and it is hereby certified to be, the bargaining agent for a unit comprising:

all pilots employed by Air Georgian Limited, excluding supervisors, those above the rank of supervisor, crew chief, chief pilot, maintenance director, operations director, flight operations manager, production manager, training manager, charter coordinator, contract liaison, lead hand, flight safety officer and controller.
