[1] Upon request from the Complainant and the Commission for an Order regarding the production of certain information;
[2] And upon noting the consent of the Respondent, Health Canada, to the production of certain information on the condition that it is included in an order of the Tribunal with certain stipulations, the Tribunal orders as follows:
- The Respondent, Health Canada, shall immediately produce to counsel for the Complainant and the Commission, the names of the individuals who have been identified at Tab 1 of Health Canada’s Disclosure Documents.
- The names may only be disclosed to the parties and the parties’ expert(s) and may only be used for the purposes of this hearing.
- The parties, their counsel, and their expert witnesses shall not use these names to contact the individuals. Furthermore, the parties, their counsel and their expert witnesses shall not disclose these names to any other individuals.
- The expert report of the Complainant or Commission shall be served on the parties no later than March 1, 2003, or five days after the production of the names, whichever is later.
- The expert report in reply of the Respondent, if any, shall be served on the parties 30 days after receipt of the expert report of the Complainant and Commission, subject to the right of the Respondent to request a further extension if necessary.
- In the event that there are any difficulties arising out of this Order, the parties may contact the Tribunal to make further submissions.
