Jeremey Pete filed a complaint with the Tribunal but has not responded to the Tribunal since January 2023. After many attempts to contact him, the Tribunal sent a letter by registered mail to Mr. Pete in July of 2023. The letter said that if he did not respond by a certain date, his complaint could be dismissed. He did not respond by the required date. The Tribunal finds that he has abandoned his complaint and, as a result, dismisses his complaint. The file will be closed.

[1] Jeremey Pete, the complainant, has failed to meet Tribunal deadlines to proceed with his complaint. The Tribunal has attempted to contact Mr. Pete on multiple occasions, but he has not responded to any of the Tribunal’s communications since January 2023 when he provided an updated mailing address and contact information.
[2] The Tribunal also asked the Commission and the respondent, Correctional Service Canada, if they had another address for Mr. Pete or were aware of any other way to reach him. The other parties had no further information and confirmed the address that the Tribunal had on file for Mr. Pete. The Registry also tried to contact Mr. Pete by telephone at the number he provided but it is out of service.
[3] The Tribunal sent a letter to Mr. Pete and the other parties on July 13, 2023, warning Mr. Pete that if he failed to respond by August 4, 2023, his complaint could be dismissed as abandoned. The letter was sent by email and courier. The delivery by courier was confirmed as delivered to Mr. Pete on July 21, 2023, including a signature confirmation. The email was not returned as undeliverable.
[4] Mr. Pete has not responded to the Tribunal’s communications and the time for doing so has passed.
[5] In the circumstances, Mr. Pete is deemed to have abandoned his complaint. The complaint is dismissed, and the Tribunal’s file will be closed.
ORDER
[6] The complaint is dismissed as abandoned. The Tribunal’s file will be closed, and the Registrar will advise the parties accordingly.
