NOVA SCOTIA UTILITY AND REVIEW BOARD

 

 

IN THE MATTER OF THE GAS DISTRIBUTION ACT

 

- and -

 

IN THE MATTER OF A REQUEST by STRAIT AREA GAS CORPORATION to SURRENDER ITS GAS DISTRIBUTION FRANCHISE

ORDER

 

WHEREAS the Nova Scotia Utility and Review Board (“Board”), in its September 29, 2004 decision granted a full regulation class gas distribution franchise (“franchise”) to Strait Area Gas Corporation (“Strait”), subject to meeting certain conditions precedent and subject to the approval of the Governor in Council;

 

AND WHEREAS the conditions precedent have not all been met and accordingly Governor in Council approval was not sought;

 

AND WHEREAS in its October 7, 2014 letter to the Board, Strait requested that the Board accept the surrender of the franchise on the grounds that Strait is unable to satisfy the conditions precedent;

 

AND WHEREAS a Notice of Surrender of Franchise was advertised as directed in the Board’s October 22, 2014 letter to Strait;

 

AND WHEREAS no comments were received by the Board;

 

AND WHEREAS the Board has the authority under section 19 of the Gas Distribution Regulations to accept surrender of a franchise;

 

IT IS HEREBY ORDERED that the Board accepts the surrender of Strait’s franchise.
