Summary:

On June 8, 2015, ATCO Gas and Pipelines Ltd. (ATCO Gas), CU Inc. (CUI) and Canadian Utilities Limited (CU) (collectively, the applicants) filed an application with the Alberta Utilities Commission requesting approval to sell their Calgary Service Centre (CSC) assets to ATCO Real Estate Holdings Ltd., a wholly-owned subsidiary company of CU. The applicants sought approval from the Commission on the basis that the disposition of the CSC assets was outside of the ordinary course of business of the utility and accordingly required the approval of the Commission pursuant to Section 26(2)(d) of the Gas Utilities Act, RSA 2000, c. G-5.
