- 1 -Ottawa, July 29, 2004 File: 2004-UO/TI-20 Reasons for the Decision On May 18, 2004, Ms. Dominique Marquis, historian residing in Montreal (“the applicant”) filed a licence application to reproduce headlines and excerpts from articles published in the L’Action catholique between 1910 and 1938. For the purposes of this decision, the Board assumes, without deciding, that what the applicant seeks to reproduce are “works” within the meaning of the Copyright Act. That proposition is open to challenge with respect to newspaper headlines, given that a title rarely is considered such a work. Based on the record of these proceedings, the Board concludes that the identity of those who authored what the applicant seeks to reproduce is not known. Section 6.1 of the Copyright Act reads as follows: “6.1 Except as provided in section 6.2, [which is not relevant for these purposes] where the identity of the author of a work is unknown, copyright in the work shall subsist for whichever of the following terms ends earlier : (a) a term consisting of the remainder of the calendar year of the first publication of the work and a period of fifty years following the end of that calendar year, and (b) a term consisting of the remainder of the calendar year of the making of the work and a period of seventy-five years following the end of that calendar year,Ottawa, le 29 juillet 2004 Dossier : 2004-UO/TI-20 Motifs de la décision Le 18 mai 2004, Dominique Marquis, historienne domiciliée à Montréal («la requérante») a déposé une demande de licence pour la reproduction de «unes» et d’extraits d’articles parus dans L’Action catholique entre 1910 et 1938. Pour les fins de la présente décision, la Commission tient pour acquis, sans pour autant se prononcer, que ce qu’on entend reproduire sont des œuvres au sens où l’entend la Loi sur le droit d’auteur. On pourrait en effet mettre en doute cette proposition dans le cas des «unes» de journaux, puisqu’il est rare que le statut d’œuvre soit accordé à un titre. En se fondant sur la preuve versée au dossier, la Commission en vient à la conclusion que l’identité de l’auteur de ce que la requérante désire reproduire n’est pas connue. Or, l’article 6.1 de la Loi sur le droit d’auteur prévoit ce qui suit : «6.1 Sous réserve de l’article 6.2, [non pertinent en l’espèce] lorsque l’identité de l’auteur d’une œuvre n’est pas connue, le droit d’auteur subsiste jusqu’à celle de ces deux dates qui survient en premier : a) soit la fin de la cinquantième année suivant celle de la première publication de l’œuvre; b) soit la fin de la soixante-quinzième année suivant celle de la création de l’œuvre.
- 2 but where, during that term, the author’s identity becomes commonly known, the term provided in section 6 applies.” Since what the applicant intends to reproduce are anonymous works published more than fifty years ago, there is no doubt, pursuant to paragraph 6.1(a), that these “works” are in the public domain. No authorization is needed to reproduce what is in the public domain. For this reason, the application is dismissed.
