Non-exclusive licence issued to the Roman Catholic Bishop of Kamloops, Kamloops, B.C., authorizing the reproduction and distribution of three colouring books published by Guild Press, New York

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board grants a licence to Roman Catholic Bishop of Kamloops, as follows:

(1) The licence authorizes the reproduction of the following three colouring books:

Title: Jonas and the Whale: A Story Book for Little Catholics to Color and Read (A Catechetical Guild book)

Creators: by Anne K. Phelan; pictures by Mel Crawford

Publisher: Guild Press (distributed by Golden Press, New York), 1961

Title: The Rosary: A Story Book for Little Catholics to Color and Read (A Catechetical Guild book)

Creators: pictures by Emma C. McKean

Publisher: Guild Press (New York), 1955

Title: The Life of the Blessed Virgin: A Story Book for Little Catholics to Color and Read (A Catechetical Guild book)

Creators: by Rev. Louis A. Gales; pictures by Chester Sullivan

Publisher: Guild Press (New York), 1961

No more than 125 copies of each book will be produced.

The issuance of the licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on February 12, 2015. All copies must be produced by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The licensee shall ensure that the following credit is prominently presented:

“The Rosary: A Story Book for Little Catholics to Color and Read pictures by Emma C. McKean. Used with permission under a non-exclusive licence issued by the Copyright Board of Canada in co-operation with Access Copyright, The Canadian Copyright Licensing Agency.”

“The Life of the Blessed Virgin: A Story Book for Little Catholics to Color and Read authored by Rev. Louis A. Gales; Pictures by Cherster Sullivan. Used with permission under a non-exclusive licence issued by the Copyright Board of Canada in co -operation with Access Copyright, the Canadian Copyright Licensing Agency.”

“Jonas and the Whale: A Story Book for Little Catholics to Color and Read authored by Anne K. Phelan; pictures by Mel Crawford. Used with permission under a non-exclusive licence issued by the Copyright Board of Canada in co-operation with Access Copyright, The Canadian Copyright Licensing Agency.”

(5) The licensee will pay to Access Copyright, The Canadian Copyright Licensing Agency, a royalty fee of $200. Access Copyright may dispose of the amount as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before February 12, 2020, ownership of copyright of the works covered by this licence.

(6) The coming into force of this licence is conditional on Access Copyright filing with the Board a notice of receipt which confirms that the royalties, as specified in paragraph (5) above, have been received and that Access Copyright undertakes to comply with the conditions set out in same.
