Copyright Board Canada [TRANSLATION] Ottawa, September 26, 2011 FILE 2011-UO/TI-24 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Nolin synchronization, reproduction and communication to the public by telecommunication of an excerpt of a song

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Nolin BBDO as follows:

(1) The licence authorizes the synchronization, reproduction and communication to the public by telecommunication of one 30-second excerpt and two 15-second excerpts of the musical work Le temps est bon, written by Stéphane Venne and published by JFM Investments Inc., for the purposes of a television advertising campaign.

(2) The licence expires on September 30, 2016. Any authorized reproduction must be completed by that date.

(3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The licensee will pay $8750 to the Society for Reproduction Rights of Authors, Composers and Publishers in Canada (SODRAC), which may dispose of this amount as it sees fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who establishes, before September 30, 2021, that it has ownership of the rights held by JFM Investments Inc. in 1972 in the work covered by this licence.

(5) The coming into force of this licence is conditional on SODRAC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SODRAC to comply with the conditions set out in paragraph (4) above.
