Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, May 22, 2008 FILE 2006-UO/TI-43 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Production GFP (III) Inc., Montréal, Quebec, for the communication to the public by telecommunication of television program excerpts

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to Production GFP (III) Inc. as follows:

(1) The licence authorizes the communication to the public by telecommunication of the following television program excerpts in the Ici Louis-José Houde series broadcast on Radio-Canada between the months of January and April 2006:

a 43-second excerpt from the children’s series Maman Fonfon written by Hubert Blais and broadcast on January 19, 1957, on Radio-Canada;

a 29-second excerpt from the children’s series Opération mystère written by Léon Dewinne and broadcast on March 29, 1959, on Radio-Canada;

a 2-second excerpt from the play Je vous ai tant aimé written by Jovette Bernier and broadcast on June 16, 1959, on Radio-Canada;

a 50-second excerpt and a 16-second excerpt from the play Le Grand Duc written by Gilles Rochette and broadcast on December 15, 1960, on Radio-Canada; and

a 12-second excerpt from the children’s series Les Contes Orientaux written by Marie T. Daoust and broadcast on March 13, 1979, on Radio-Canada.

The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(2) The licence expires on December 31, 2009. (3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

- 2 - (4) Production GFP (III) Inc. will pay Société des Auteurs de Radio, Télévision et Cinéma (SARTEC) the total sum of $2,400 (or $300 for each 30-second segment) broken down as follows:

$600 for the excerpt from the children’s series Maman Fonfon written by Hubert Blais

$300 for the excerpt from the children’s series Opération mystère written by Léon Dewinne

$300 for the excerpt from the play Je vous ai tant aimé written by Jovette Bernier $900 for the two excerpts from the play Le Grand Duc written by Gilles Rochette $300 for the excerpt from the children’s series Les Contes Orientaux written by Marie T. Daoust.

SARTEC may dispose of the amount of the royalties set by the licence as it sees fit for the general benefit of its members. It undertakes, however, to reimburse any person who establishes, before December 31, 2014, ownership of the copyright in one of the works covered by this licence.

(5) The coming into force of this licence is conditional on SARTEC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SARTEC to comply with the conditions set out in paragraph (4) above.
