Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, April 8, 2008 FILE 2008-UO/TI-03 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to the National Film Board of Canada authorizing the reproduction and incorporation of a cartoon in a documentary film

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board issues a licence to the National Film Board of Canada as follows:

(1) The licence authorizes the reproduction and incorporation, in a documentary film, of a cartoon created by Stewart Cameron and published in 1943 in his book Basic Training Daze: Candid Cartoons of You and Me in the Army (publisher unknown).

The cinematographic image of the cartoon will appear for up to 20 seconds in the 52-minute documentary film Open Secrets.

The licence also authorizes the public performance or communication to the public by telecommunication of the cartoon so incorporated, as well as its reproduction on any medium for the purpose of distribution for private performance, as part of the exploitation of the documentary film.

This licence does not release the licensee from the obligation to obtain permission for any use not covered by this licence.

(2) The licence is for five years and expires on December 31, 2013. (3) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(4) The National Film Board will pay the sum of $173 to the Canadian Artists Representation Copyright Collective (CARCC), which may dispose of the royalties set by the licence as it sees fit for the general benefit of its members. CARCC undertakes, however, to reimburse any person who establishes, before December 31, 2018, ownership of the copyright in the work covered by this licence.

- 2 - (5) The coming into force of this licence is conditional on CARCC filing with the Board of the receipt for the amount of the licence, accompanied by an undertaking by CARCC to comply with the conditions set out in paragraph (4) above.
