Copyright Board Commission du droit d’auteur Canada Canada [TRANSLATION] Ottawa, October 14, 2008 FILE 2008-UO/TI-17 UNLOCATABLE COPYRIGHT OWNERS Non-exclusive licence issued to Mireille Barrière, Montréal, Quebec, authorizing the reproduction of 2 photographs in a book

Pursuant to the provisions of subsection 77(1) of the Copyright Act, the Copyright Board of Canada issues a licence to Mireille Barrière, as follows:

(1) The licence authorizes the reproduction of the following two photographs, taken by Georges Tinguely (Studio Lausanne de Montréal), in the book Le chant d’une femme, co­written by the applicant and Colette Boky:

a photo of Colette (Giroux) Boky, surrounded by Jacques Normand, Paul Berval, Doris Lussier and Normand Hudon during the Miss Island King ’56 contest, published in Radiomonde et Télémondeon September 15, 1956; and

a photo of Colette Boky, surrounded by Raymond Ruelland, Jean Deslauriers, Lucille Dumont and Raoul Jobin during the contest Les découvertes de la cire Succès (1958), published in Radiomonde et Télémondeon April 26, 1958.

(2) No more than 2500 copies will be reproduced. (3) The licence expires on December 31, 2010. Authorized reproduction must be completed by this date.

(4) The licence is non-exclusive and valid only in Canada. For other countries, it is the law of that country that applies.

(5) The issuance of this licence does not release the licensee from the obligation to obtain permission for any other use not covered by this licence.

(6) The licensee will pay the sum of $130 (or $65/photo) to the Society for Reproduction Rights of Authors, Composers and Publishers in Canada Visual Arts and Crafts (SODRAC), which may dispose of the amount of the royalties set by the licence as it sees

- 2 - fit for the general benefit of its members. SODRAC undertakes, however, to reimburse any person who establishes, before December 31, 2015, ownership of the copyright in any of the works covered by this licence.

(7) The licensee must clearly indicate the following in the book being written: “The photographs of Colette Boky published in Radiomonde et Télémonde on September 15, 1956 and April 26, 1958, taken by Georges Tinguely (Studio Lausanne de Montréal), are used under licence from the Copyright Right Board of Canada. If you believe you hold the rights to these works, please contact the Society for Reproduction Rights of Author, Composers and Publishers in Canada Visual Arts and Crafts (SODRAC) by December 31, 2015.”

(8) The coming into force of this licence is conditional on SODRAC filing with the Board the receipt for the amount of royalties set in the licence, accompanied by an undertaking by SODRAC to comply with the conditions set out in paragraph (6) above.
