In accordance with sections 70.14 and 67.1(5) of the Copyright Act, the Copyright Board hereby publishes the statement of roy- alties filed by the Société du droit de reproduction des auteurs, compositeurs et éditeurs au Canada (SODRAC) on March 27, 2002, with respect to royalties that it proposes to collect, effective on January 1, 2003, for the reproduction, in Canada, of musical works by community radio stations.
In accordance with the provisions of the same sections, the Board hereby gives notice that prospective users or their repre- sentatives who wish to object to the statement may file written objections with the Board, at the address indicated below, within 60 days of the publication hereof, that is no later than July 10, 2002.

Conformément aux articles 70.14 et 67.1(5) de la Loi sur le droit d’auteur, la Commission du droit d’auteur publie le projet de tarif que la Société du droit de reproduction des auteurs, compositeurs et éditeurs au Canada (SODRAC) a déposé auprès d’elle le 27 mars 2002, relativement aux redevances qu’elle propose de percevoir, à compter du 1 er janvier 2003, pour la reproduction, au Canada, d’œuvres musicales par les stations de radio communautaires.
Conformément aux dispositions des mêmes articles, la Com-mission donne avis, par les présentes, que tout utilisateur éventuel intéressé, ou son représentant, désirant s’opposer à ce projet de tarif doit déposer son opposition auprès de la Commission, par écrit, à l’adresse apparaissant ci-dessous, dans les 60 jours de la présente publication, soit au plus tard le 10 juillet 2002.

Tariff No. 3.B REPRODUCTION OF MUSICAL WORKS BY COMMUNITY RADIO STATIONS
For a license during calendar years 2003, 2004 and 2005 authorizing the reproduction of works in SODRAC’s repertoire by a radio station and the use of copies resulting from such repro- ductions for radio broadcasting purposes, the following royalties, terms and conditions shall apply :
1. Definitions In this tariff, the following expressions mean:
1.1 “repertoire” the musical and dramatic-musical works in SODRAC’s repertoire; in this tariff a musical work includes a dramatic-musical work.
1.2 “reproduction” the fixation by a radio station of a work in the repertoire by any analog, numeric, known or to be discovered process, in any format or material form, including the fixation on the hard-disk of a computer.
1.3 “radio station” a radio station licensed to operate as a community radio station under the Broadcasting Act except those licensed to operate in the English language.
1.4 “copy” any format or material form on or under which a work in the repertoire is fixed by a radio station by any known or to be discovered process.
2. Application 2.1 This tariff authorizes only the reproduction of a work in the repertoire made by a radio station and the use of a copy resulting from such reproduction for radio broadcasting purposes.
2.2 This tariff authorizes reproductions by a radio station of the works in the repertoire, in whole or in part, and their embodiment in a montage, a compilation, a mix or a medley, moral rights be- ing reserved.
2.3 This tariff does not authorize a radio station to reproduce a work in the repertoire or use a copy resulting from such repro- duction in association with a product, service, cause or institution.
2.4 This tariff does not authorize a radio station to use for pur- poses other than broadcasting a copy resulting from a reproduc- tion of a work in the repertoire.
3. Royalties and Payment 3.1 A radio station shall pay to SODRAC on the first of Janu- ary of each year an annual comprehensive royalty rate of $250.
3.2 Upon payment of the royalty, a radio station may reproduce works in the repertoire and use resulting copies as often as needed for its broadcasting purposes.
4. Administrative Provisions 4.1 At the same time and in the same form, a radio station for- wards to SODRAC information on the musical content of its pro- gramming (radio logs) that it is required to provide to SOCAN.

Tarif n o 3.B REPRODUCTION D’ŒUVRES MUSICALES PAR UNE STATION DE RADIO COMMUNAUTAIRE
Les redevances à verser à la SODRAC et les modalités à respecter pour une licence durant les années civiles 2003, 2004 et 2005 autorisant la reproduction des œuvres du répertoire de la SODRAC par une station de radio et l’utilisation à des fins de radiodiffusion des supports qui en résultent, sont les suivantes :
1. Définitions Aux fins du présent tarif, les termes suivants se définissent comme suit :
1.1 « répertoire » signifie le répertoire des œuvres musicales et dramatico-musicales de la SODRAC; dans ce tarif, l’œuvre musi-cale comprend l’œuvre dramatico-musicale.
1.2 « reproduction » signifie la fixation par une station de radio d’une œuvre du répertoire par un procédé analogique, numérique ou par tout autre procédé connu ou à découvrir, sur un support quelconque, y compris la fixation sur le disque dur d’un ordinateur.
1.3 « station de radio » signifie une station de radio titulaire d’une licence d’opération de radio communautaire délivrée en vertu de la Loi sur la radiodiffusion sauf celle licencée pour opérer en langue anglaise.
1.4 « support » signifie toute forme matérielle sous laquelle une œuvre du répertoire est fixée par une station de radio par quelque procédé connu ou à découvrir.
2. Application 2.1 Le présent tarif autorise uniquement la reproduction d’une œuvre du répertoire faite par une station de radio et l’utilisation à des fins de radiodiffusion du support qui en résulte.
2.2 Le présent tarif autorise une station de radio à reproduire en tout ou en partie sur un support les œuvres du répertoire et à les incorporer dans un montage, une compilation, un mixage ou un pot-pourri, le tout sous réserve du droit moral des ayants droit.
2.3 Le présent tarif n’autorise pas une station de radio à reproduire une œuvre du répertoire ou à utiliser un support qui en résulte en liaison avec un produit, une cause, un service ou une institution.
2.4 Le présent tarif n’autorise pas une station de radio à utiliser un support résultant d’une reproduction d’une œuvre du répertoire à d’autres fins que la radiodiffusion.
3. Redevances et paiement 3.1 La station de radio paie à la SODRAC au 1 er janvier de chaque année une redevance à un taux forfaitaire annuel de 250 $.
3.2 Le paiement à la SODRAC de cette redevance permet à la station de radio de faire le nombre de reproductions nécessaires aux fins de son entreprise de radiodiffusion et d’utiliser à des fins de radiodiffusion les supports qui en résultent le nombre de fois désiré.
4. Dispositions administratives 4.1 Au même moment et sous la même forme, la station de ra-dio transmet à la SODRAC l’information sur les contenus musicaux de sa programmation qu’elle est requise de transmettre selon sa licence de la SOCAN.
Le 11 mai 2002 4.2 A radio station shall keep all accounts and records from which information required under this tariff can easily be ascer- tained for a period of two years.
4.3 Accounts and records and logs of a radio station may be audited by SODRAC during normal business hours and on rea- sonable notice in order to verify information given.
4.4 Any amount not received by the due date shall bear interest from that date until the date the amount is received. Interest shall be calculated daily at a rate equal to one per cent above the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada). Interest shall not compound.
4.5 All payable royalties are exclusive of any federal, provin- cial or other governmental taxes or levies, whether direct or indirect.
5. Termination 5.1 Upon 30 days written notice, SODRAC shall have the right at any time to terminate a license granted to a radio station under this tariff for non-application or breach of any one of the terms or conditions of the license prescribed in this tariff.
6. Addresses for notices 6.1 All communications to SODRAC shall be sent to 759 Square Victoria, Suite 420, Montréal, Quebec H2Y 2J7, or to any other address of which the radio station has been notified in writing.
6.2 All communications from SODRAC to the radio station shall be sent to the address provided to the Canadian Radio- television and Telecommunications Commission (CRTC) or to any other address of which SODRAC has been notified in writing.
Supplément à la Gazette du Canada 5 4.2 La station de radio tient et conserve tous les livres et registres permettant aisément de retrouver les informations nécessaires à l’application du présent tarif pour une période de 2 ans.
4.3 Les livres, registres et enregistrements de la station de radio pourront être vérifiés par la SODRAC pendant les heures de bureau régulières, moyennant un préavis raisonnable, afin de confirmer chacune des informations transmises.
4.4 Tout montant non payé à son échéance porte intérêt à compter de la date à laquelle il aurait dû être acquitté jusqu’à la date où il est reçu. Le montant des intérêts est calculé quotidien-nement, à un taux de un pour cent au-dessus du taux d’escompte de la Banque du Canada en vigueur le dernier jour du mois précédent (tel qu’il est publié par la Banque du Canada). L’intérêt n’est pas composé.
4.5 La redevance est payable en sus des taxes directes ou indirectes des gouvernements fédéral et provincial ou d’un autre pa-lier de gouvernement.
5. Résiliation 5.1 La SODRAC peut, en tout temps, mettre fin à une licence accordée à une station de radio en vertu du présent tarif sur pré-avis écrit de 30 jours pour violation ou non-application de l’une quelconque des conditions ou modalités de la licence établies au présent tarif.
6. Adresses pour les avis 6.1 Toute communication destinée à la SODRAC est expédiée au 759, Carré Victoria, Bureau 420, Montréal (Québec) H2Y 2J7 ou à toute autre adresse dont la station de radio aura été avisée par écrit par la SODRAC.
6.2 Toute communication de la SODRAC à la station de radio est expédiée à l’adresse fournie au Conseil de la radiodiffusion et des télécommunications canadiennes (CRTC) ou à toute adresse dont la SODRAC aura été avisée par écrit.
