Statement of Proposed Royalties to Be Collected for the Public Performance or the Communication to the Public by Telecommunication, in Canada, of Musical and Dramatico- Musical Works
In accordance with subsection 67.1(5) of the Copyright Act, the Copyright Board hereby publishes the statement of royalties filed by the Society of Composers, Authors and Music Publishers of Canada (SOCAN) on June 13, 2003, with respect to royalties that it proposes to collect, effective on January 1, 2005, for the public performance or the communication to the public by telecommuni- cation, in Canada, of musical or dramatico-musical works by commercial radio stations.
In accordance with the provisions of the same subsection, the Board hereby gives notice that all prospective users or their repre- sentative who wish to object to the statement may file written objections with the Board, at the address indicated below, within 60 days of the publication hereof, that is no later than August 27, 2003.

Conformément au paragraphe 67.1(5) de la Loi sur le droit dauteur, la Commission du droit dauteur publie le projet de tarif que la Société canadienne des auteurs, compositeurs et éditeurs de musique (SOCAN) a déposé auprès delle le 13 juin 2003, relativement aux redevances quelle propose de percevoir à compter du 1 er janvier 2005, pour lexécution en public ou la communication au public par télécommunication, au Canada, duvres musicales ou dramatico-musicales par les stations de radio commerciales.
Conformément aux dispositions du même paragraphe, la Com-mission donne avis, par les présentes, que tout utilisateur éventuel intéressé, ou son représentant, désirant sopposer audit projet de tarif doit déposer son opposition auprès de la Commission, par écrit, à ladresse apparaissant ci-dessous, dans les 60 jours de la présente publication, soit au plus tard le 27 août 2003.

in compensation for the right to perform in public or to communi- cate to the public by telecommunication, in Canada, musical or dramatico-musical works forming part of its repertoire.
GENERAL PROVISIONS All amounts payable under this tariff are exclusive of any fed- eral, provincial or other governmental taxes or levies of any kind.
As used in this tariff, the terms licence, licence to perform and licence to communicate to the public by telecommunication mean a licence to perform in public or to communicate to the public by telecommunication or to authorize the performance in public or the communication to the public by telecommunication, as the context may require.
Except where otherwise specified, fees payable for any licence granted by SOCAN shall be due and payable upon grant of the licence, and any amount not received by the due date shall bear interest from that date until the date the amount is received. Inter- est shall be calculated daily, at the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada) plus one percent. Interest shall not compound.
Each licence shall subsist according to the terms set out therein. SOCAN shall have the right at any time to terminate a licence for breach of terms or conditions upon 30 days notice in writing.
Tariff No. 1 RADIO A. Commercial Radio For a monthly licence to perform, at any time and as often as desired in 2005, 2006 and 2007, for private or domestic use, any or all of the works in SOCANs repertoire by a commercial radio station, the fee payable shall be a percentage of the stations gross income for the second month before the month for which the li- cence is issued.
For a station that (a) has broadcast works in SOCANs repertoire for less than 20 per cent of its total broadcast time in the second month be- fore the month for which the licence is issued, and
(b) keeps and makes available to SOCAN complete recordings of its last 90 broadcast days, the percentage shall be 2.6 per cent.
For any other station, the percentage shall be 6 per cent.
For the purpose of establishing the rate applicable to a station, no account shall be taken of production music (i.e. music used in interstitial programming such as commercials, public service an- nouncements and jingles).
Gross income means the gross amounts paid, including the fair market value of any goods or services provided by way of contra, trade, barter or any similar arrangement, by any person for

DISPOSITIONS GÉNÉRALES Les montants exigibles indiqués dans le présent tarif ne com-prennent ni les taxes fédérales, provinciales ou autres, ni les prélèvements dautre genre qui pourraient sappliquer.
Dans le présent tarif, « licence », « licence permettant lexécu-tion » et «licence permettant la communication au public par télé-communication » signifient, selon le contexte, une licence dexécution en public ou de communication au public par télé-communication ou une licence permettant dautoriser une tierce partie à exécuter en public ou à communiquer au public par télécommunication.
Sauf indication contraire, les droits relatifs à toute licence oc-troyée par la SOCAN sont dus et payables dès loctroi de la li-cence. Tout montant produit des intérêts à compter de la date à laquelle il aurait dû être acquitté jusquà la date où il est reçu. Le montant des intérêts est calculé quotidiennement, à un taux de un pour cent au-dessus du taux descompte de la Banque du Canada en vigueur le dernier jour du mois précédent (tel quil est publié par la Banque du Canada). Lintérêt nest pas composé.
Chaque licence reste valable en fonction des conditions qui y sont énoncées. La SOCAN peut, en tout temps, mettre fin à toute licence sur préavis écrit de 30 jours pour violation des modalités de la licence.
Tarif n o 1 RADIO A. Radio commerciale Pour une licence mensuelle permettant lexécution en tout temps et aussi souvent que désiré en 2005, 2006 et 2007, à des fins privées ou domestiques, de lune ou de la totalité des uvres faisant partie du répertoire de la SOCAN sur les ondes dune station de radio commerciale, la redevance payable sera un pourcentage des revenus bruts de la station pour le mois antérieur au mois qui précède celui pour lequel la licence est émise.
Le pourcentage applicable à la station qui a) a diffusé des uvres faisant partie du répertoire de la SOCAN durant moins de 20 pour cent de son temps dantenne total au cours du mois antérieur au mois qui précède celui pour
lequel la licence est émise, et qui b) conserve et met à la disposition de la SOCAN lenregistre-ment complet de ses 90 derniers jours de diffusion, est de 2,6 pour cent.
Le pourcentage applicable à toute autre station est de 6 pour cent.
Dans létablissement du taux applicable à une station, il nest pas tenu compte de la musique de production, incorporée notamment aux messages publicitaires, aux messages dintérêt public et aux ritournelles.
« Revenus bruts » sentend des sommes brutes payées pour lutilisation dune ou de plusieurs des installations ou services de diffusion offerts par lexploitant de la station, y compris la juste
Le 28 juin 2003 the use of one or more broadcasting services or facilities provided by the stations operator, excluding the following:
(a) income accruing from investments, rents or any other busi- ness unrelated to the stations broadcasting activities. However, income accruing from any allied or subsidiary business that is a necessary adjunct to the stations broadcasting services and fa- cilities or which results in their being used shall be included in the gross income.
(b) amounts received for the production of a program that is commissioned by someone other than the licensee and which becomes the property of that person.
(c) the recovery of any amount paid to obtain the exclusive na- tional or provincial broadcast rights to a sporting event, if the licensee can establish that the station was also paid normal fees for station time and facilities. SOCAN may require the produc- tion of the contract granting these rights together with the bill- ing or correspondence relating to the use of these rights by other parties.
(d) amounts received by an originating station acting on behalf of a group of stations, which do not constitute a permanent network and which broadcast a single event, simultaneously or on a delayed basis, that the originating station subsequently pays out to the other stations participating in the broadcast. These amounts paid to each participating station are part of that stations gross income.
No later than the day before the first day of the month for which the licence is issued, the licensee shall pay the fee, and report the stations gross income for the second month before the month for which the licence is issued.
Upon receipt of a written request from SOCAN, the station shall provide to SOCAN, with respect to all musical works (in- cluding program themes and music cues) broadcast by the station during the days selected by SOCAN:
(a) the date and time of broadcast; (b) the title of the musical work and the names of the authors and composers of the work; and
(c) the title of the sound recording containing the musical work, the names of the performers and/or performing groups and the record label.
The information shall be provided in electronic format where possible, otherwise in writing, no later than 14 days after the end of the month to which they relate.
SOCAN may request the music use information with respect to no more than 21 days in any given year.
A station shall keep and preserve, for a period of six months after the end of the month to which they relate, records from which the music use information can be readily ascertained.
SOCAN shall have the right to audit the licensees books and records, on reasonable notice and during normal business hours, to verify the information rendered and the fee payable by the licensee.
Tariff 1.A does not apply to the use of music covered under Tariff 22 or SOCANs Pay Audio Services tariff.

Il est entendu que les revenus provenant dactivités indirectement reliées ou associées aux activités de diffusion, qui en sont le complément nécessaire ou ayant comme conséquence lutilisa-
tion des services et installations de diffusion, font partie des « revenus bruts ».
b) les sommes versées pour la réalisation dune émission pour
le compte dune personne autre que le titulaire de la licence et qui en devient le propriétaire.
c) les sommes reçues en recouvrement du coût dacquisition de droits exclusifs, nationaux ou provinciaux, de diffusion de manifestations sportives, dans la mesure où le titulaire de la licence établit que la station a aussi perçu des revenus normaux pour lutilisation du temps dantenne et des installations de la
station. La SOCAN aura le droit dexiger la production du contrat dacquisition de ces droits, ainsi que des factures ou autres documents se rattachant à lusage de ces droits par des tiers.
d) les sommes reçues par une station source agissant pour le compte dun groupe de stations qui ne constituent pas un ré-seau permanent et qui diffusent, simultanément ou en différé, un événement particulier, que la station source remet ensuite aux autres stations participant à la diffusion. Les sommes ainsi remises à chaque station participante font partie des « revenus bruts » de cette station participante.
Au plus tard le jour avant le premier du mois pour lequel la li-cence est émise, le titulaire de la licence versera la redevance exigible, accompagnée dun rapport établissant les revenus bruts de la station pour le mois antérieur au mois qui précède celui pour lequel la licence est émise.
Sur demande écrite de la SOCAN, la station lui fournit les renseignements suivants à légard de toutes les uvres musicales (y compris les thèmes dune émission et les « cue » musicaux) quelle a diffusés durant les jours choisis par la SOCAN :
a) la date et lheure de la diffusion; b) le titre de luvre musicale, les noms des auteurs et compositeurs de luvre; et
c) le titre de lenregistrement contenant luvre, les nom des artistes-interprètes ou groupes dinterprètes et celui de la mai-son de disque.
La station fournit les renseignements au plus tard 14 jours après la fin du mois auquel ils se rapportent, si possible sous forme électronique et sinon, par écrit.
La SOCAN peut demander les renseignements à légard de 21 jours par année.
La station tient et conserve durant six mois après la fin du mois auquel ils se rapportent les registres permettant à la SOCAN de déterminer facilement les renseignements demandés.
La SOCAN aura le droit de vérifier les livres et registres du ti-tulaire de la licence durant les heures de bureau régulières, moyennant un préavis raisonnable, afin de confirmer linforma-tion soumise par le titulaire de la licence et la redevance exigible de ce dernier.
Lusage de musique expressément assujetti au tarif 22 et au ta-rif pour les Services Sonores Payants nest pas assujetti au présent tarif.
