In accordance with subsection 72(1) of the Copyright Act, the Copyright Board publishes the statement of royalties filed by the Société du droit de reproduction des auteurs, compositeurs et éditeurs au Canada (SODRAC) on March 23, 1999, with respect to royalties that it proposes to collect, effective on January 1, 2000, for the reproduction, in Canada, of musical, artistic, literary and dramatic works by educational institutions.
And in accordance with the provisions of the same subsection, the Board hereby gives notice that educational institutions or their representatives who wish to object to the statement may file written objections with the Board, at the address indicated below, within 60 days of the publication hereof, that is no later than July 28, 1999.

Conformément au paragraphe 72(1) de la Loi sur le droit d’auteur, la Commission du droit d’auteur publie le projet de tarif que la Société du droit de reproduction des auteurs, compositeurs et éditeurs au Canada (SODRAC) a déposé auprès d’elle le 23 mars 1999, relativement aux droits qu’elle propose de perce-voir, à compter du 1 er janvier 2000, pour la reproduction, au Canada, d’œuvres musicales, artistiques, littéraires et dramatiques par des établissements d’enseignement.
Et conformément aux dispositions du même paragraphe, la Commission donne avis, par les présentes, que les établissements d’enseignement ou leur représentant désirant s’opposer audit projet de tarif doivent déposer leur opposition auprès de la Commission, par écrit, à l’adresse apparaissant ci-dessous, dans les 60 jours de la présente publication, soit au plus tard le 28 juillet 1999.

REPRODUCTION OF MUSICAL, ARTISTIC, LITERARY AND DRAMATIC WORKS BY EDUCATIONAL INSTITUTIONS
For a license during calendar years 2000, 2001 and 2002, authorizing the reproduction of works in SODRAC’s repertoire at the time of their communication to the public by telecommunica- tion and their use by educational institutions, the following royal- ties and conditions shall apply:
1. Definitions In this tariff, the following expressions shall have the following meaning:
1.1 Broadcasting and communication to the public by tele- communication include radio broadcasting, television broadcast- ing and communication on an electronic network.
1.2 “Educational institution” means (a) a non-profit institution licensed or recognized by or un- der an Act of Parliament or the legislature of a province to provide pre-school, elementary, secondary or post-secondary education;
(b) a non-profit institution that is directed or controlled by a board of education regulated by or under an Act of the legisla- ture of a province and that provides continuing, professional or vocational education or training;
(c) a department or agency of any order of government, or any non-profit body, that controls or supervises education or train- ing referred to in paragraphs (a) or (b), or;
(d) any other non-profit institution prescribed by regulation. 1.3 “Work” means a musical, literary, dramatic or artistic work.
1.4 “Work in the repertoire” means a musical, literary, dramatic or artistic work in SODRAC’s repertoire.
2. Application 2.1 This tariff applies to the making of a single copy, for edu- cational or training purposes, of a work in the repertoire at the time that it is communicated to the public by telecommunication, when such copy is not destroyed within the year after its making if the work is performed in a news program or in a news commen- tary program or within thirty days in all other cases.
2.2 The making of a copy of a work in the repertoire by an educational institution other than at the time of its communication to the public by telecommunication is not covered by this tariff being subject to a distinct and prior written authorization from SODRAC.
Is also not covered by this tariff the making of more than a single copy of a work in the repertoire, the making of a copy for purposes other than educational or training purposes or for a pur- pose other than the showing to students of the institution of a news programs or a news commentary program.
Uses of the copy of a work in the repertoire other than public performance before an audience consisting primarily of students of the educational institution on its premises and for educational or training purposes is forbidden unless a distinct and prior writ- ten authorization from SODRAC is obtained.

REPRODUCTION D’ŒUVRES MUSICALES, ARTISTIQUES, LITTÉRAIRES ET DRAMATIQUES PAR DES ÉTABLISSEMENTS D’ENSEIGNEMENT
Pour une licence durant les années civiles 2000, 2001 et 2002 autorisant la reproduction des œuvres du répertoire de la SODRAC lors de leur communication au public par télécommunication et leur utilisation par les établissements d’enseignement, les redevances et modalités suivantes s’appliquent :
1. Définitions Aux fins de l’application du présent tarif, les termes suivants se définissent comme suit :
1.1 La diffusion et la communication au public par télécommunication comprennent la radiodiffusion, la télédiffusion et la communication sur un réseau informatique.
1.2 « Établissement d’enseignement » signifie a) un établissement sans but lucratif agréé aux termes des lois fédérales ou provinciales pour dispenser de l’enseignement aux niveaux préscolaire, élémentaire, secondaire ou postsecondaire, ou reconnu comme tel;
b) un établissement sans but lucratif placé sous l’autorité d’un conseil scolaire régi par une loi provinciale et qui dispense des cours d’éducation ou de formation permanente, technique ou professionnelle;
c) un ministère ou organisme, quel que soit l’ordre de gouver-nement, ou entité sans but lucratif qui exerce une autorité sur l’enseignement et la formation visés aux alinéas a) et b);
d) tout autre établissement sans but lucratif visé par règlement. 1.3 « Œuvre » signifie une œuvre musicale, littéraire, dramatique ou artistique.
1.4 « Œuvre du répertoire » signifie une œuvre musicale, littéraire, dramatique ou artistique du répertoire de la SODRAC.
2. Application 2.1 Le présent tarif vise la reproduction, à des fins pédagogiques, en un seul exemplaire, d’une œuvre du répertoire lors de sa communication au public par télécommunication, lorsque cet exemplaire n’est pas détruit dans l’année qui suit la reproduction si l’œuvre est exécutée dans une émission ou un commentaire d’actualités, ou dans les trente jours pour les autres cas.
2.2 La reproduction d’une œuvre du répertoire par un établis-sement d’enseignement qui n’est pas effectuée à partir d’une communication au public par télécommunication est exclue du présent tarif et doit faire l’objet d’une autorisation écrite, distincte et préalable de la SODRAC.
Il en est de même pour la reproduction d’une œuvre du répertoire en plus d’un exemplaire, à une fin autre que pédagogique ou à une fin autre que la présentation aux étudiants de l’établisse-ment d’une émission ou d’un commentaire d’actualités.
L’utilisation d’une reproduction d’une œuvre du répertoire au-tre que l’exécution publique devant un auditoire formé principalement d’étudiants de l’établissement, dans ses locaux et à des fins pédagogiques, est interdite à moins d’autorisation écrite, distincte et préalable de la SODRAC.
Le 29 mai 1999 3. Royalties 3.1 Educational institutions shall pay to SODRAC a yearly royalty of 10¢ for each pre-school, elementary and secondary student and of 20¢ for each post-secondary student for the repro- ducing of a work in the repertoire to which this Tariff applies.
3.2 The calculation of the number of students shall be based on the number of students enrolled in or otherwise receiving educa- tion from such educational institution as of December 31 of the previous calendar year.
3.3 An educational institution that commences operation under this tariff after the beginning of a calendar year may pro-rate the royalties for that year to the number of days remaining in that calendar year.
3.4 An educational institution commences operation within a calendar year on the earlier of :
(a) the first day that a copy of a work is made, or (b) the first day of the current calendar year when the expira- tion of the period provided on section 2.1 for a copy of a work made during the previous calendar year occurs during the cur- rent calendar year.
3.5 All payable royalties are exclusive of any federal, provin- cial or other governmental taxes or levies, whether direct or indirect.
4. Administrative Provisions 4.1 When an educational institution makes a copy of a work, it shall record all information mentioned and in the form provided for in Appendix A or in any other way SODRAC may authorize.
4.2 The educational institution shall mark on the copy or on the container in which it is kept, the title of the work, the language, the time and date of broadcasting, the name or call sign of the broadcaster, and, if known, the performer and the title of the pro- gram in which the work was performed. Shall also be indicated the fact that it was a news program or a news commentary program.
4.3 When the copy of a work comprised in a news program or in a news commentary program is destroyed within the year of its making, the educational institution shall fill out the certification provided in Appendix A and indicate the name, title and signature of the person who destroyed such copy and the date of the destruction.
When such copy is not destroyed within a year, the educational institution shall certify it in accordance with Appendix A.
In all other cases, when the copy is destroyed within 30 days of its making, the educational institution shall fill out the certificate provided in Appendix A indicating the name, title and signature of the person who destroyed such copy and the date of the destruction.
When such copy is not destroyed within a 30-day period, the educational institution shall certify it in accordance with Ap- pendix A.
4.4 For each work copied, the institution shall certify the num- ber of copies that were made in accordance with Appendix A.
4.5 Within 60 days of the end of a quarter, the educational in- stitution shall send to SODRAC a copy duly filled out of the form prescribed in Appendix A for each work copied during that

Redevances 3.1 Les établissements d’enseignement paient à la SODRAC une redevance annuelle de 0,10 ¢ par étudiant des niveaux préscolaire, primaire et secondaire et de 0,20 ¢ par étudiant des niveaux postsecondaires pour la reproduction d’une œuvre du répertoire prévue au présent tarif.
3.2 Le calcul du nombre d’étudiants est fondé sur le nombre d’étudiants inscrits ou recevant de l’enseignement dans cet établissement au 31 décembre de l’année civile qui précède.
3.3 Un établissement d’enseignement qui commence à fonctionner en vertu du présent tarif après le début d’une année civile peut calculer les redevances pour cette année au prorata du nom-bre de jours qui restent dans cette année civile.
3.4 Un établissement d’enseignement commence à fonctionner dans une année civile
a) le premier jour où un exemplaire d’une œuvre est confectionné ou
b) le premier jour de l’année en cours lorsque l’échéance de conservation prévue à l’article 2.1 d’un exemplaire de l’œuvre confectionné dans l’année civile antérieure survient dans l’année en cours,
selon la première des deux éventualités. 3.5 Les redevances sont payables en sus des taxes directes ou indirectes du gouvernement fédéral, provincial ou d’un autre pa-lier de gouvernement.
4. Dispositions administratives 4.1 L’établissement d’enseignement qui reproduit une œuvre consigne les renseignements prévus à l’annexe A et en la forme y prévue, ou de toute autre façon que la SODRAC autorise.
4.2 L’établissement d’enseignement inscrit sur l’exemplaire ou sur le boîtier dans lequel il est conservé, le titre de l’œuvre, la langue, l’heure et la date de la diffusion, le nom ou l’indicatif d’appel du diffuseur, ainsi que, si connus, l’interprète de l’œuvre et le nom de l’émission dans laquelle elle était exécutée. Le fait qu’il s’agisse d’une émission d’actualités ou d’un commentaire d’actualités doit être inscrit.
4.3 Lorsque l’exemplaire d’une œuvre dans une émission d’actualités ou d’un commentaire d’actualités est détruit dans l’année de sa confection, l’établissement d’enseignement doit compléter l’attestation prévue à l’annexe A en indiquant les nom, poste et signature de la personne qui a détruit l’exemplaire et la date de cette destruction.
Lorsque cet exemplaire n’est pas détruit dans l’année, l’établissement d’enseignement doit en attester conformément à l’annexe A.
Dans les autres cas, lorsque l’exemplaire est détruit dans les 30 jours de sa confection, l’établissement d’enseignement doit compléter l’attestation prévue à l’annexe A en indiquant les nom, poste et signature de la personne qui a détruit l’exemplaire et la date de cette destruction.
Lorsque cet exemplaire n’est pas détruit dans les 30 jours, l’établissement d’enseignement doit en attester conformément à l’annexe A.
4.4 L’établissement doit, pour chaque œuvre reproduite, attester du nombre d’exemplaires effectués conformément à l’an-nexe A.
4.5 L’établissement d’enseignement fait parvenir à la SODRAC, dans les 60 jours de la fin d’un trimestre, une copie dûment complétée du formulaire établi à l’annexe A à l’égard de

4.6 Royalties shall be paid by the educational institution to SODRAC within 60 days following the last day of the end of each quarter.
4.7 The following information shall be provided with the pay- ment of royalties :
— name and address of the educational institution; and — number of students enrolled in or otherwise receiving educa- tion from such institution as of December 31 of the previous calendar year.
4.8 The educational institution shall keep all accounts and re- cords from which royalties payable and information required un- der this Tariff can easily be ascertained. The educational institu- tion shall keep such accounts and records for a period of six years.
4.9 Accounts and records of the educational institution, includ- ing the ones kept in accordance with by-laws, may be audited by SODRAC during normal business hours and on reasonable notice in order to verify information given and royalties payable. SODRAC may require specific pieces of evidence related to the destruction of copies.
4.10 Should any audit disclose that royalties paid were under- stated by more than 5 percent, the educational institution shall pay the costs of audit within 30 days of the demand by SODRAC of such payment.
4.11 Royalties bear interest from the due date until the date the amount is received. Interest shall be calculated daily at the Bank Rate effective on the last day of the previous month (as published by the Bank of Canada) plus one per cent. Interest shall not compound.
4.12 Royalties found to be owing through an audit shall bear the same interest from the date they were due until the date they are received.
5. Addresses for Notices 5.1 All communications to SODRAC shall be sent to 759 Square Victoria, Suite 420, Montréal, Quebec H2Y 2J7, or to any other address of which the institution has been notified in writing.
5.2 All communications from SODRAC to the educational institution shall be sent to the address provided to SODRAC in accordance with Appendix A, or to any other address of which SODRAC has been notified in writing.

4.6 Les redevances doivent être versées par l’établissement d’enseignement à la SODRAC dans les 60 jours suivant le dernier jour de la fin de chaque trimestre.
4.7 Le versement de la redevance doit être accompagné des in-formations suivantes :
— les nom et adresse de l’établissement; — le nombre d’étudiants inscrits ou recevant autrement de l’en-seignement de cet établissement au 31 décembre de l’année civile qui précède.
4.8 L’établissement d’enseignement tient et conserve tous les livres et registres permettant aisément de déterminer les redevances exigibles et de retrouver les informations nécessaires à l’application du présent tarif. L’établissement d’enseignement doit conserver ces livres et registres pendant six ans.
4.9 Les livres et registres de l’établissement d’enseignement y compris ceux tenus conformément aux règlements administratifs pourront être vérifiés par la SODRAC pendant les heures de bu-reau régulières, moyennant un préavis raisonnable, afin de con-firmer chacune des informations transmises et les redevances exigibles. La SODRAC peut notamment exiger certains éléments de preuve reliés à la destruction des exemplaires.
4.10 Dans le cas où une vérification démontre un écart de 5 pour cent ou plus entre les redevances payées et celles exigibles, les frais de vérification seront à la charge entière de l’établissement d’enseignement, qui les paiera dans les 30 jours d’une demande en ce sens de la SODRAC.
4.11 Toute redevance porte intérêt à compter de la date à laquelle elle aurait dû être acquittée jusqu’à la date où elle est reçue. Le montant des intérêts est calculé chaque jour au taux d’escompte en vigueur le dernier jour du mois précédent, tel qu’il est publié dans la revue de la Banque du Canada, plus un pour cent. L’intérêt n’est pas composé.
4.12 La redevance dont l’exigibilité ressort d’une vérification porte intérêt au même taux, et ce, à compter de la date à laquelle elle aurait dû être acquittée initialement.
5. Adresses pour les avis 5.1 Toute communication destinée à la SODRAC est expédiée au 759, Carré Victoria, Bureau 420, Montréal (Québec) H2Y 2J7, ou à toute autre adresse dont l’établissement aura été avisé par écrit par SODRAC.
5.2 Toute communication de la SODRAC à l’établissement d’enseignement est expédiée à l’adresse fournie à la SODRAC sur l’annexe A ou à toute adresse dont la SODRAC aura été avi-sée par écrit.
