I. Overview

[1] On January 20, 2026, Re:Sound and the Objectors[1] (the “Parties”) jointly requested to be provided an opportunity to conduct negotiations prior to filing a Joint Statement of Issues, which was otherwise due by January 22, 2026, in accordance with the Notice of Initiation CB-CDA 2025-121, dated December 9, 2025.

[2] In their request, the Parties advised the Board that

the first Preliminary Issue identified by the Board in the Notice (Issue 1(a)) has been resolved by the parties. Re:Sound withdraws its proposed changes to the rates and reporting requirements for over-the-air broadcasting by non-commercial radio stations and accepts the status quo rate of $100 per year and the currently applicable reporting requirements under Re:Sound Tariff 1.B, for the years 2022-2029.

[3] The Parties also advised the Board that they have commenced settlement negotiations regarding the second Preliminary Issue identified by the Board in its Notice of Initiation, which concerns the rates for simulcasting and non-interactive and/or semi-interactive webcasting by non-commercial webcasters.

II. Ruling

[4] The request is granted.

[5] The Parties must file the Joint Statement of Issues by no later than Wednesday, April 22, 2026.

[6] Additionally, the Parties are requested to provide the Board with an update on the progress of the negotiations by no later than Wednesday, March 11, 2026.
