ORDER OF THE BOARD

 

Matters: Commercial Television Tariffs (2014-2024) and CBC Television Tariffs
(2015-2025)

 

July 11, 2024

[1] A case management conference (“CMC”) was held on July 3, 2024, to allow parties to provide various status updates.

I. RULING

[2] Shortly before the CMC, the concerned parties filed a joint request to approve SOCAN Tariff 2.A – Television – Commercial Television Stations (2014-2024) and SOCAN Tariff 17 –Transmission of Pay, Specialty & Other Television Services by Distribution Undertakings (2014-2024) based on a jointly-submitted text (“JST”).

[3] I informed the parties that the decision on this request would be made by a panel to be designated by the Chair of the Board. As such, the examination of these proposed tariffs will be the subject-matter of a distinct proceeding. This proceeding is now initiated and will be in the form of a written hearing based on the parties’ submissions and the JST.

II. NEXT STEPS - ORDER

[4] During the CMC, the following undertakings were made:

• SOCAN Tariffs 2.A and 17 (2025-2027):

 

SOCAN will provide a written update on next steps by Tuesday, October 1, 2024, after it engages discussions with objectors;

 

• SOCAN Tariff 2.D (2015-2025):

 

CBC will provide SOCAN with a response to their “settlement” offer, and update the Board on the status of discussions and next steps by Friday, September 6, 2024; and

 

• Reproduction Tariffs:

 

The parties will confer among themselves to discuss the issues at play and agreeable points including next steps to address these issues as well as to deal with (i) repertoire adjustments or a repertoire-use study (including chain of title audits) and (ii) valuation of reproduction activities, including adjustments, where necessary. The parties will report back to me on their discussions at the next CMC. I would, however, ask parties to provide me with a proposed schedule of proceedings prior to the CMC.

[5] Regarding the next CMC, I am available at the following dates and time:

1) Tuesday, October 1, 2024, from 1:30 p.m.-2:30 p.m.

2) Thursday, October 3, 2024, from 10:30 a.m.-11:30 a.m.

3) Thursday, October 3, 2024, from 1:30 p.m.-2:30 p.m.

[6] Parties shall confirm their availability for the CMC by Friday, July 26, 2024.
