ORDER OF THE BOARD

 

Matters: Re:Sound Tariff 5.A to 5.J – Live Events (2016-2020); Re:Sound Tariff 5.A to 5.J – Live Events (2021-2025)

October 31, 2023

[1] On June 14, 2023, the Board issued Order CB-CDA 2023-036 requesting that Re:Sound provide additional information about its settlement discussions with the objectors to the Re:Sound 5.A to 5.J proposed tariffs for the years 2016-2020 and 2021-2025.

[2] Re:Sound was asked to provide i) a status update addressing the progress made in their settlement discussions ii) an estimated timeline(s) for the conclusion of the settlement discussions iii) a potential date for filing a jointly submitted text. Re:Sound was also asked to identify which objectors have still not participated in these discussions and explain why.

[3] In its response dated September 14, 2023, Re:Sound informed the Board that it had reached an agreement in principle with CAPACOA, CLMA, CAFE, the Sports Objectors, and Québecor. Re:Sound also informed the Board that the parties estimated that the agreements would be finalized and the draft tariffs ready to be submitted to the Board within 3 months’ time, if not sooner.

[4] In respect of Restaurants Canada and HAC, Re:Sound confirmed that both parties had provided a substantive response to its settlement proposal but that an agreement in principle had not yet been reached and that the parties required further time to continue their settlement discussions.

[5] Re:Sound further informed the Board that it not had received a response to its settlement proposal from the following objectors : the Federation of Calgary Communities (FCC) and the Retail Council of Canada (RCC). FCC is an objector to Re:Sound Tariff 5.A-J for the years 2016 to 2020. RCC is an objector to Re:Sound Tariff 5.B for the years 2021-2025.

[6] Re:Sound proposed to provide a further update on the status of any remaining discussions in three months.

[7] By no later than Tuesday, January 30, 2024, Re:Sound shall file a status update addressing the progress made in their settlement discussions with Restaurants Canada and HAC and estimated timeline(s) for the conclusion of those discussions.

[8] By that same date, the FCC and the RCC shall inform the Board of their interest in participating in the consideration of the proposed tariffs to which they have objected. Failure to respond will result in these parties being considered as not participating in the consideration of the proposed tariffs.
