RULING OF THE BOARD

 

File: Re:Sound Tariff 8 (2013-2018)

October 27, 2022

 

[1] On October 25, 2022, the Board granted motions by Pandora and SiriusXM to file sur-replies to the reply case of Re:Sound, with a deadline of November 1, 2022, in Order CB-CDA 2022-061.

[2] Around the same time the Board’s order was issued, Re:Sound wrote to the Board requesting leave to reply to the motions by Pandora and SiriusXM, with the purpose of explaining why those motions should not be granted. In addition, several hours after the Board’s order was issued, SiriusXM wrote to the Board, requesting an extension to its deadline until November 8, 2022.

[3] The request by SiriusXM is granted. The Board notes that SiriusXM made its request for an extension in a timely manner.

[4] Should Re:Sound wish to respond in writing to the sur-replies of Pandora and Sirius XM, the Board will accept a sur-sur-reply that deals only with issues raised in the sur-replies, not to exceed three pages in length; Re:Sound’s sur-sur-reply shall be filed no later than November 15, 2022.

[5] The Board expects that there will be no further filings arising from Re:Sound’s reply, including no sur-sur-sur-replies.
