ORDER OF THE BOARD
File: Online Music Services (SOCAN: 2007-2018)

I.
Order 1: Schedule of Proceedings
[1] Having received the Parties’ Statements of Case, the Board hereby issues a revised Schedule of Proceedings.
[2] In particular:
- No day for “hot tub” of expert witnesses is required, and is removed from the Schedule of Proceeding.
- Parties must file any presentation aids and similar material by October 7, 2022.
[3] The number of days for the hearing will be fixed after receipt of Parties’ response to Notice CB-CDA 2022-046.
II.
Order 2: Directive on Proceeding: No new documents during hearing
[4] Section 9 of the Directive on Procedure CB-CDA 2017-161 is replaced by the following:
- No party may—without leave from the Board—file a new document during the hearing, unless it is to be used only for the purposes of cross-examination of a witness.
- Accordingly, any presentation aid or similar material must be filed by the date fixed in the Schedule of Proceeding.
III.
Order 3: Final Submissions
[5] The day for Closing Argument will be fixed at a later time by the Board, but will not be—in any case—later than the date currently fixed for Final Submissions, being January 23, 2023. The Closing Arguments will constitute the Parties’ final submissions.
