Redetermination of
Tariff for the Retransmission of Distant Television Signals, 2014-2018
Reasons for Decision
[1] On May 8, 2025, the Federal Court of Appeal (the “Court”) set aside the Board’s redetermination of Tariff for the Retransmission of Distant Television Signals, 2014-2018 [Redetermination], 2024 CB 1[1].
[2] In its Judgement, the Court directed the Board to issue a new tariff with the rates contemplated in paragraphs 47 and 48 of its Reasons for Judgment. In these paragraphs, it specifies the “Appropriate Tariff Rate” for each of the years 2014-2018.
[3] Furthermore, in paragraph 49, the Court stated that “[t]he rates for systems other than large systems should be determined based on the rates for large systems, as listed in the table above, and adjusted as indicated in paragraph 162 of the Redetermination Decision.”
[4] In accordance with these directions, I hereby approve the Television Retransmission Tariff, 2014-2018.
[5] The forms in Appendix B of the tariff have not changed; therefore, Appendix B is not re-published with the new tariff.
