Interim tariffs for the retransmission of distant radio and television signals during 1998
Reasons for decision
At the request of the Copyright Collective of Canada, the Board adopts, as interim tariffs to be paid for the retransmission of distant radio and television signals during 1998, the text attached to this interim decision. It is similar to the text of the tariffs certified for the years 1995 to 1997. Only a few adjustments were required to reflect the coming into force of various provisions of Bill C-32 (S.C. 1997, c. 24) and of new Broadcasting Procedures and Rules. These adjustments are found at section 2 (definitions of "LPTV", "retransmitter", "signal" and "small retransmission system") of the television and radio tariffs.
The forms contained in Appendices B of the tariffs for 1995 to 1997 shall be used for the interim tariffs. As to Form 2, the form that was used in 1997 shall be used in 1998.
A reference is added to the Société des Auteurs et Compositeurs Dramatiques in Appendix A of the television tariff and to the Canadian Retransmission Right Association in Appendix A of the radio tariff, to reflect the fact that these societies now make separate claims. However, the retransmitters’ payment obligations remain the same as in 1997.
