MOTION ORDER
[1] The Applicant filed a records application with the Condominium Authority Tribunal (CAT). The application related to records requested 15, August, 2025. The Application was accepted and moved to Stage 1 – Negotiation.
[2] On September, 18, the Applicant filed a motion to add a second records request to this case. This records request was submitted July 31, 2025. The board responded to the request on August 1, 2025.
[3] The CAT requested submissions from the Respondent on the request to add the second records request. The Respondent did not reply to the request for submissions.
[4] I am granting the motion to add records. Section 1.39 of the Act requires the CAT “adopt the most expeditious method of determining the questions arising in a proceeding before it that affords to all persons directly affected by the proceeding an adequate opportunity to know the issues and to be heard on matters in the proceeding”. The case is still in Negotiation, and it would be a burden to both parties to require a second case be added. The Negotiation remains in its early stage, and the parties have a chance to resolve all related issues in this case.
[5] I will order the request of July 31, 2025 to be added to this case, and order the Applicant to upload the related Records Request, and Response forms to the case Documents.
ORDER
[6] The Tribunal orders that:
1. The request of July 31, 2025 to be added to this case.
2. Within 14 days of this order the Applicant must upload the July 31, 2025 Records Request Form, and August 1, 2025 Response Form to the case Documents.
