DISMISSAL ORDER

[1]       An application was submitted to the Condominium Authority Tribunal (CAT) on April 25, 2025. The CAT has reviewed the application, and issued a Notice of Intent to Dismiss this application under Rule 19.1 of the CAT’s Rules of Practice for the following reasons:

1.         The application deals with a request for “the source information used for the defamatory letter”. This is a request for information. The request does not identify a record that the corporation is required to maintain. This issue is outside of the CAT’s jurisdiction and the CAT does not have the legal power to hear or decide it.

2.         The application has no reasonable prospect of success based on the lack of jurisdiction.

[2]       The Applicant acknowledged receipt of the Notice of Intent to Dismiss the Case, but did not respond to the reasons to dismiss the case.

[3]       The Application is dismissed per rule 19.1(b) of the CAT’s Rules of Practice because the request does not identify a record the corporation is required to maintain.

ORDER

[4]       The Tribunal orders the application dismissed.
