DATE: May 9, 2025
CASE:
2024-00755R
Citation: Akash v. York Condominium Corporation No. 78, 2025 ONCAT 76

Order under section 1.44 of the Condominium Act, 1998.

Member: Anna Boudria, Member

The Applicant,
Ahmed Akash
Self-Represented

The Respondent,
York Condominium Corporation No. 78
Represented by Michael Spears, Counsel

MOTION ORDER

[1]       On April 21, 2025, the Tribunal dismissed this case. After receiving the dismissal order, the Respondents’ Representative filed a motion requesting the matter be reopened for the sole purpose of seeking costs.

[2]       Rule 47 of the CAT’s Rules of Practice outlines the circumstances where the CAT can reopen the case. The reasons for the Respondent’s request are to consider an additional cost order.

[3]       Having considered the Respondent’s request and Rule 47, I have determined that reopening the matter at this juncture solely to address costs is not warranted. This matter has been addressed by way of a dismissal and the circumstances leading up to the dismissal have already been addressed.

ORDER

[4]       The motion is dismissed.
