ORDER

[1]       An application was brought to the Condominium Authority Tribunal (CAT) regarding a Request for Records made by the Applicant on July 13, 2023. Parties acknowledge that the requested records have been provided to the Applicant.

[2]       In the CAT online dispute resolution system, the Parties agreed to settle this case in Stage 2 - Mediation through Terms of Settlement dated January 16, 2024.

[3]       The parties did undertake to protect the privilege, privacy and confidentiality of the terms and conditions of this settlement from third parties, and agreed not disclose them, other than to counsel or to a court or a lawful government agency, if so required.

[4]       Under Rule 34.3 (c) of the CAT’s Rules of Practice, the CAT can close a case if the Applicant has properly informed the CAT that the Parties have settled the case. Accordingly, the CAT orders that this case be closed.

ORDER

[5]       The CAT orders that:

1.         This case is closed in Stage 2 – Mediation under Rule 34.3 (c) of the CAT’s Rules of Practice and shall not be reopened.

2.         Messages from the Stage 2 Tribunal Member are not to be shared or disclosed.

3.         The Parties may share a copy of any document they received during this case if required by law, such as to a government organization or a court.
