WITHDRAWAL ORDER
[1] The Applicant filed an application with the Condominium Authority Tribunal (CAT) regarding a Request for Records dated March 1, 2022, and a Request for Records dated July 13, 2022. The case commenced in Stage 3 - Tribunal Decision on November 30, 2022.
[2] On August 24, 2023, the Applicant informed this Tribunal Member that they were provided with records that were at issue. The Applicant asked to withdraw the case and indicated that neither party is seeking an award of costs.
[3] The Respondent was given time and opportunity to make submissions on the request to withdraw the case. The Respondent did not make any submissions.
[4] Under Rule 43.1 of the CAT’s Rules of Practice, the CAT can close a case in Stage 3 - Tribunal Decision if the Applicant has informed the CAT that they wish to withdraw their case.
[5] The CAT accepts the Applicant’s withdrawal of this case and I order that this case be closed.
ORDER
[6] The Tribunal orders that:
1. This case is closed in Stage 3 - Tribunal Decision under Rule 43.1 of the CAT’s Rules of Practice, without an award of costs.
2. All messages and any documents that contain settlement-related messages or settlement offers that were shared in Stage 1 - Negotiation and/or Stage 2 - Mediation of this case are private and confidential.
