CONSENT ORDER

[1]       In the Condominium Authority Tribunal’s (CAT) online dispute resolution system, the Parties agreed to settle this case in Stage 2- Mediation (“Stage 2”).

[2]       This application involved a noise complaint. During Stage 2, the parties tried to come to an understanding of the positions of each side. The Applicant (“the condominium corporation”), installed weather stripping to the front door of each unit to try to assist with sound absorption.

[3]       The Applicant delivered a copy of the condominium corporation’s governing documents respecting ‘quiet enjoyment’ to the Intervenor and Respondent Ms. O’Hanlon, on Sept 14 2022, and mailed a copy to the Respondent Mar-Car Management Ltd, on Sept 14 2022. The Respondent Mar-Car Management Ltd., who is an owner of one of the condominium units, had minimal participation in this Stage 2 process, but also agreed to the issuing and wording of this Order.

[4]       All parties are aware of the condominium corporation’s ‘quiet enjoyment rules’ and will make best efforts to abide by those rules.

[5]       Under Rule 34.3 of the CAT’s Rules of Practice, the CAT can close a case in Stage 2 – Mediation if the Parties agree to the CAT making a consent order that resolves the dispute.

[6]       With the consent of the Parties, the CAT orders that this case has been resolved, and that this file may be closed and not be reopened.

ORDER

[7]       This case has been resolved in Stage 2 and will be closed and cannot be reopened.
