MOTION ORDER

[1]       Mr. Rob Russell owns a condominium unit in York Condominium Corporation No. 50 (“YCC50”) and has brought an application to this Tribunal concerning three Requests of Records that he has made under the Condominium Act, 1998. The three Requests for Records are dated October 23, 2020, November 23, 2020 and January 18, 2021.

[2]       After bringing his application but before the hearing in this matter began, Mr. Russell made a fourth Request for Records on March 29, 2021. YCC50 has now made its response to this request. Mr. Russell is unsatisfied with aspects of that response and brings this motion to add his March 29, 2021 Request for Records and the issues arising from it to the issues to be determined in this hearing.

[3]       YCC50 consents to adding this fourth Request for Records to this matter. I conclude that it would be more efficient and fairer for both parties to have all four Requests for Records dealt with in one hearing.

ORDER

[4]       Accordingly, under Rule 4 of the Condominium Authority Tribunal’s Rules of Practice, I order that Mr. Russell’s Request for Records of March 29, 2021 and the issues arising from it be included as part of the hearing in this matter.
