ORDER

 

 

[1]       Yingying Liu (the “Applicant”) is a unit owner of Toronto Standard Condominium Corporation No. 2329 (the “Respondent”). The Applicant requested financial records and records pertaining to a shared facilities agreement. The case advanced to a Stage 3 – Tribunal Decision for determination by the Condominium Authority Tribunal (the “Tribunal”). 

 

[2]       Despite questioning the adequacy of the Applicant’s request, Counsel for the Respondent provided nineteen (19) records to the Applicant through the Condominium Authority Tribunal’s Online Dispute Resolution system (“CAT-ODR system”). The Applicant reviewed the records provided by the Respondent on the CAT-ODR system prior to any evidence being heard.

 

[3]       The Applicant was satisfied with the records provided by the Respondent.

 

[4]       Both Applicant and Respondent (collectively, the “Users”) then confirmed that the issues before the Tribunal had been resolved and there was no need to proceed further with the hearing.

 

[5]       I commend the Users for working together to find a mutually agreeable outcome. I recognize that their communications on the CAT-ODR system also gave rise to shared understanding of how concerns beyond the Tribunal’s jurisdiction could be addressed. I commend this as well. 

 

[6]       Costs were not raised for consideration. Each of the Users is to therefore bear their own costs for their participation in this case.

 

[7]       As the Users have resolved the issues before the Tribunal, I order that this case be closed.
