CONSENT ORDER

[1]       Using the Condominium Authority’s Tribunal online system, the Applicant, Namasivayam Thayaparan, and the Respondent, Metro Toronto Condominium Corporation 996, have both agreed to settle this case. 

[2]       CAT Member Susan Sapin therefore orders, on consent, that this case has been resolved without a hearing, based on the following terms and conditions:


ORDER

[3]       Mr. Thayaparan filled out the Request for Records Form by hand. These are the documents Mr. Thayaparan requested be provided to him in electronic format, and MTCC 996 has agreed to provide:

 

1.         Copies of contractor’s invoices for exterior work done to replace sealant for “1.5 M” as per Auditor’s Report p. 6 of 12;

2.         Invoices and the “GL” report for the following as per the Auditor’s Report:

A.        Full statements of the Reserve Fund for the year end November 30, 2017 (all entries);

B.        Windows and doors - $15,046;

C.       Security - $3,338;

D.       Plumbing - $16,989

E.        Other contracts - $16,018, p.5/12, Auditor’s Report;

F.        [sic] Security $41,871, p.5/12, Auditor’s Report;

G.       [sic] General repair and maintenance - $77,708, p. 5/12 of Auditor’s  Report;

H.       Engineering consulting report $1,723, under administration p.5/12;

I.          Heating etc. - $33,840, under repairs and maintenance, p. 5/12;

J.         Heating, ventilation etc. - $46,280, under contracts p.5/12;

K.        Invoice for “Professional Engineering” - $46,496, charged under the reserve fund for 2016.


COMPLIANCE

[4]       If either Namasivayam Thayaparan or Metro Toronto Condominium Corporation 996 fails to comply with any of the terms of this order, it may be enforced by through the Ontario Superior Court of Justice.
