Witness #1 g ave e app el l ant and d id not he ar the ministr y worker t ell t he appellant but rathe r, s he recal ls the w orker tellin g t he app ell ant t hat as long a lowest , it w ould b e acc epte d. I n r esponse t o q uest ions, W i t ness #1 conf ir med that aft er took up residence with her at the new residence immediately and di Wit ness #1 r ecalled t hat the mov e started in April af ter the app how many hours it woul d take to comple te the move until the original house around the 30 t h of May 2014. Witness #2 is the appellant's friend who prepared the RFR Letter and the appellant's other current He gave evid ence t h at he wa s introduced to the appellant by Witness #1 who was at the ti his roommate. He knew the appellant as an anxious p erson a medi cal problem that led to her hospitalization. Witness #2 indicated that he owned a ¾ tonne truck that he offered to the appellant to use for her move and that the cos $500. In response to questions, Witness #2 recalled that the appellant's move from her old residence began in April 2014 and went on until the end of May 2014. He recalled that he lice Witness #2 confirmed that he completed the eviction notice that was submitted by the appellant and that she had brought it to him from the ministry. Witness #2 confirmed that he assisted the appellant in preparing Quote #3 and that it was oreoared once the move was laraelv comoleted. PART F -Reasons for Panel Decisio n The i s sue on the app eal is whether the Ministry rea sonabl of moving costs. The ministry found th a t th e app ellant satisfied section Assistance for Persons w ith Disabilities Regulati on ("EAPW red uc e d a s a re s ult of the m ove. H o w e ver, the ministry further determin for a mo vin g sup plem ent fo r the follow ing reasons: (a) The app e ll a n t did not receive the minister's app ro se c ti on 55(3)(b) of the EAPWDR; and (b) The ministry was not sat i sfi ed that tha t the moving costs inc expensive mode o f moving a s r equired by section 55(4)(a) of th The criteria for eligibil ity for a movi ng supplement are set out in se Su pp lements f o r m o ving, trans portati o n a nd living co st s 55 ( 1) In t h is se c ti on : " l i ving cost" means th e cos t of acco mmod a tion a n d meals; "movin g cost" me a ns t he cos t of m o ving a famil y unit a n d its pe " tran sportat ion c o st" means th e cost of tra velling from o ne place to (2) Subjec t to subsecti on s (3) a nd (4), t he mi nist e r m a y provide disab il ity a ssist ance or hardship a s sist ance t o a ss ist wi t h one or ( a) mo ving costs r equir ed to m ove anywhere in C anada , i f a re c on firmed employme nt t hat wo uld sig n ificantl y pr omo t e t h e financ r equ ired t o move to begi n that employment; ( b ) moving c osts require d t o mo v e to anothe r provi nce or country, if circ umstance s ; ( c) moving cost s re qu ire d to m ove w ithin a muni c i pal i ty or un incor unin c o r por ate d a rea becaus e the fa mi ly unit's rented r e s idential acc to vacate has been given, or has be en co nd em ned; {d) moving cost s r equired t o move w it h in a muni c ipal ity or u n i nc unincorporated area if the family unit's shelter costs would be significantly reduced as a result of the move; ( e) moving costs required to move to another area in British Columbia to avo any person in the family unit; (f) transportat i on costs and living cost s r equir e d to at tend a h e Child, Family and Community SeNice Act, if a recipient is given notice of the hearing and is a party to the proceeding; (g) transportation costs, living costs, child care costs and fees (i) the required attendance of a recipient in the fami ly unit at a hearing, or (ii) other requireme nts a recipient in the family u nit must f u l fil in connection with the exercise of a ma i n t ena nce right as signed ass ign maintenance rig hts]. (3) A family unit is eligible for a supplement under this section only if (a) there are no resources available to the family unit to cover the costs for which t (b) a recipient in the family unit receives the minister's approval before incurring those costs. She says she feel s badl p ai d . At the hearing, the app ell ant stated further that s h quote s to t h e min ist r y and tha t she w a s told by t he minis it w o uld be se lected for appr oval. This is supp or te with the a p pellant. F ur ther, the appellant g ave e v id ence that sh as Witness #2's q u o te was the lowest, h is would be ap proved. The appellant prepared two quotes and provided them to the ministry. ministry on May 21, 2014. Quote #1 provides a "rough estimate" of $15,000 although this was later revised to $1,500.00. Q uote #2 provides a cost of between $2,500 and $3,000 for removal of art further co st of $158/h our for all other moving costs. In the Reconsideration Decision both of these quotes were deemed by the m i n i st r y to be too high and unrea s onable. appellant submitted quote #3 to the ministry which provided the actual costs of moving at $1,876 and truck rental. Returning to the Reconsideration Decision, the minist ry unrea sonable and d id not satisfy s.55(4 ) (a ) of the EAPWDR as being the least expensive appropriate mode of movina but it does not provide anv reasons for that view. Despite the panel's f inding wi th r es pect t o the unre a sonable nat a pp ell ant's moving costs w er e no t th e least expe n s ive appropriate n atu r e of sect ion 55(3}(b) o f the EAPW DR, the p ane l fi nds th e appellant did no t re ceive the min ist er's a p pro v a l before has reques t e d reimb urse m e n t in the fo rm of a mo v ing s upp Conclus ion Gi ven the p a nel's fin d i ng s a bove, the panel fi nds tha t the mi sup ported by t h e eviden ce and c o nfirms the de c isi o n pursuant to Section 24(2)( As si stan ce Act.
