The ministry has ac cepted th at t he ap pellant was entitled to consideration for a movin wi t hin his municipality because his shelter cos t s would be significantly t he ap pellant's mon t hl y income i s $6 1 0 .00, he may not h The ministry's continued o bjection, as outlined within the Reconsideration Decision, is that the incurred on April 4, 2014 were incurr e d with o ut the mi nister's pre-r equisite te r ms of the legislation. The appellant's posi tion (c ontained within his June 5, 2014 email and ar rang ements we re last minute, and although he t ried to c "messed up" but not ma l i c i ous ly or without understanding receiv e d by the Tribunal on May 15, 2014, he wrote t ha t h last moment, and so he had no option but to proceed w ithout ad The panel notes the ministry's determination tha t the appell (shelter c o sts re d u ced} and 57(3}(a ) (no other a v a ilab le r Sec tio n 57 ( 3) (b) o f t he EAR requi r es th at the reci pie n t of the mov appro val before incurri ng th ose cos ts. T here fi n d s the m inistry was reasonable i n conc l ud ing th at c leaning definition of moving costs. The Panel finds the mini s t ry's decision that the appellant was not eligible for a moving supplement because he incurred the moving costs before receiv in g the minister's legislatio n in the circumstances of the appellant and confirms the reconsideration decision.
