I APPEAL# his wife are each more than 60 years old, they do not receive income assistance. Therefore, the Ministry reasonably concluded that the Appellant does not meet the requirements section 66(b). With respect to the provisions in section 66( c), the Panel finds that although the Ministry accepted that the Appellant would receive an OAS pension except for the residency requirement, the Ministry reasonably determined that the combined income of the Appellant and his wife of more than $33,000 in 2012 exceeded the maximum income threshold of $22,080 for receiving OAS. Therefore, the Ministry reasonably concluded that the Appellant did not meet the eligibility requirements for a bus pass supplement under section 66(c) of the EAR. In conclusion, after considering all of the evidence and the applicable enactments, the Panel finds that the Ministry's reconsideration decision was reasonably supported by the evidence and therefore the Panel confirms that decision.
